The Impact of Artificial Intelligence on the Workers’ Mental Health and Related Legal Mechanisms: A Comparative Study with French Law

Background and Aim: The right to health serves as a pivotal aspect spanning three generations of human rights, encompassing negative rights, positive rights and solidarity rights. On one hand, there is a relation between right to live in first generation and the right to health and social security, the right to work in second generation and the right to a healthy environment in third generation. If the right to health is not guaranteed the other rights will be meaningless. On other hand, regarding to advancement of novel technologies like artificial intelligence the different generations of human rights especially the right to work and the right to health have been affected. In other words, because of the implementation of artificial intelligence in many fields, not only will the job security of laborers be endangered, but the dire consequences of this development might also affect their mental health. However, according to the provisions of the International Charter of Human Rights, the right to benefit from decent work, as well as refraining from creating any obstacles in the process of benefiting from decent work, is one of the important duties of the government.
Methods: In the upcoming research, the impact of using artificial intelligence on job security, legal guarantees and it’s impact on the mental health of workers will be investigated with a descriptive-analytical method in comparison with the French labor law and the use of library resources.
Ethical Considerations: The research upholds authenticity, honesty and fidelity in organizing the study.
Results: According to French labor law dismissal of workers whose contracts are terminated during technological changes is justified. Therefore, it can be said that artificial intelligence is a double-edged sword that both promotes the progress of different parts of society and creates challenges and dangers for humans. Nowadays, in order to reduce these harms, the laws of different countries, including France, consider legal solutions. Considering the challenges of artificial intelligence, including the spread of unemployment, the author is trying to propose solutions similar to the French system in order to reduce the rate of dismissal of workers and increase their mental health in Iran.
Conclusion: Based on the psychologists’ researches, unemployment has a direct impact on people’s mental health. To support workers and mitigate the mental effects of dismissal, the Iran labor law should be interpreted in alignment with other similar legal systems such as French labour law system. This ensures the protection of worker’s status, making dismissal the last resort.
