Background and Aim:The right to health as a right has led the government to establish an electronic health system in order to provide services. This system, by using the internet and the national number of individuals, has aimed to facilitate medical services and to prevent crimes such as forgery and medical treatment crimes. Therefore, the purpose of this article is to examine the role and position of electronic evidence in the proceedings of the electronic health system. Methods:This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based, referring to documents, books and articles. Ethical Considerations:In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results:The findings of the research indicate that the examples of electronic evidence are the data of content and form, which in identifying the principles of the electronic health system, we arrive at the path of the right to health and protection of citizen rights, maintaining confidentiality and security of information and central justice; Also, the functions of electronic evidence in electronic health system proceedings include the ability to present the author, date and time of registration, authenticity, storage and accessibility. Conclusion:Problems such as lack of familiarity and sufficient training, insufficient management and lack of electronic signature, access and storage standards, internet infrastructure issues have created problems. On the other hand, according to the definition of electronic evidence, the electronic health system also has the characteristics of data message, use of digital space and storage has the effects and validity of electronic evidence.
