fa جستاری بر حمایت از حق بر سلامت کودکان در برابر تغییرات اقلیمی An Inquiry into the Protection of Children’s Right to Health in the Context of Climate Change مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: کودکان به عنوان یکی از آسیب‌پذیرترین گروه‌های جامعه، جهت دستیابی به رشد سالم به شرایطی همچون محیط زیستی پاک و سالم، مراقبت‌های پزشکی با کیفیت، تغذیه مناسب، مسکن امن و حمایت‌های اجتماعی نیاز دارند. تغییرات اقلیمی، علاوه بر تهدید منابع طبیعی و اقتصادی، زمینه‌های لازم برای تحقق حق بر سلامت کودکان را به طور جدی به چالش می‌کشد. اثرات منفی تغییرات اقلیمی، از جمله آلودگی هوا، تغییر الگوهای آب و هوایی و ناپایداری منابع آبی و غذایی، مستقیماً بر سلامت جسمی و روانی کودکان تأثیر می‌گذارد و لزوم بازنگری و تدوین چهارچوب‌های حقوقی نوین جهت حمایت از این حق بنیادین را آشکار می‌سازد. روش: این پژوهش با رویکرد توصیفی ـ تحلیلی و از طریق مرور گسترده ادبیات و اسناد حقوقی و علمی، با استناد به مقالات منتشرشده به زبان انگلیسی در بازه زمانی 24-2019 از پایگاه اطلاعاتی Google Scholar و سایر منابع معتبر، به بررسی رابطه بین تغییرات اقلیمی و حق بر سلامت کودکان پرداخته است. علاوه بر تحلیل نظری، نظرات و بررسی‌های متخصصان حقوق بین‌الملل محیط زیست و حقوق کودک نیز مورد ارزیابی قرار گرفته است. ملاحظات اخلاقی: در تدوین این مقاله، اصول اخلاقی از جمله حفظ اصالت متون، صداقت علمی، امانتداری در ارائه منابع، کسب رضایت و شفاف‌سازی در اطلاع‌رسانی رعایت شده است. یافته‌ها: نتایج پژوهش نشان می‌دهد که تغییرات اقلیمی، با ایجاد شرایط نامساعد محیطی مانند آلودگی هوا، کاهش کیفیت آب و تغییر الگوهای اقلیمی، نقشی تعیین‌کننده در تهدید سلامت کودکان دارند. کمیته حقوق کودک در نظریه عمومی جدید خود، ضمن تأکید بر ارتباط بین محیط زیست و حقوق کودک، ضرورت تبیین حق بر سلامت در مقابل تهدیدات اقلیمی را برجسته نموده است. همچنین اصول و تعهدات مندرج در حقوق بین‌الملل محیط زیست به رسمیت‌شناختن دسترسی به محیط زیستی پاک و سالم به عنوان یکی از حقوق بشر اصلی، مبنای حمایت حقوقی از سلامت کودکان در مقابل اثرات تغییرات اقلیمی قرار گرفته است. نتیجه‌گیری: با استناد به نظر عمومی کمیته حقوق کودک و مفاهیم عدالت بین‌نسلی، این پژوهش استدلال می‌کند که حفاظت از حق بر سلامت کودکان در برابر تغییرات اقلیمی، مستلزم همکاری‌های بین‌المللی و به کارگیری رویکردهای حقوقی مبتنی بر اصل مسئولیت مشترک، اما متمایز است. دولت‌ها موظف به تدوین و اجرای سیاست‌هایی هستند که ضمن کاهش اثرات منفی تغییرات اقلیمی، زیرساخت‌های بهداشتی و خدمات مراقبت‌های پزشکی را در سطح ملی و منطقه‌ای تقویت نمایند. این اقدامات باید با بهره‌گیری از بهترین شواهد علمی و فناوری‌های نوین صورت پذیرد تا ضمن رعایت حقوق نسل حاضر، آینده کودکان و سلامت آنان نیز تضمین گردد.</div> <div style="text-align: justify;">Background and Aim: Children, as one of the most vulnerable segments of society, require a clean and healthy environment, quality healthcare, adequate nutrition, secure housing and social support to achieve healthy development. Climate change, in addition to threatening natural and economic resources, poses a serious challenge to the realization of children’s right to health. The adverse effects of climate change-such as air pollution, altered weather patterns and instability in water and food resources-directly impact the physical and mental health of children, thereby underscoring the urgent need to review and develop new legal frameworks to safeguard this fundamental right. Methods: This research employs a descriptive-analytical approach, utilizing an extensive review of the literature and legal and scientific documents. It relies on articles published in English between 2019 and 2024, accessed through Google Scholar and other reputable sources, to examine the relationship between climate change and children’s right to health. In addition to a theoretical analysis, the opinions and assessments of experts in international environmental law and children’s rights have also been evaluated. Ethical Considerations: In the compilation of this article, ethical aspects including preserving the authenticity of the texts, honesty, trustworthiness, satisfaction and information have been observed. Results: The findings indicate that climate change plays a decisive role in threatening children’s health by creating adverse environmental conditions, such as air pollution, diminished water quality and shifting climate patterns. The Committee on the Rights of the Child, in its new general comment, emphasizes the interconnection between environmental quality and children’s rights, highlighting the necessity of articulating the right to health in the face of climate threats. Moreover, the principles and obligations enshrined in international environmental law, which recognize access to a clean and healthy environment as a fundamental human right, form the legal basis for protecting children’s health against the impacts of climate change. Conclusion: Drawing on the Committee on the Rights of the Child’s general comment and the concept of intergenerational justice, this study argues that protecting the right to health for children in the context of climate change requires international cooperation and the adoption of legal approaches based on the principle of common but differentiated responsibilities. States are obliged to formulate and implement policies that not only mitigate the negative effects of climate change but also strengthen health infrastructures and medical care services at national and regional levels.
