fa امکان‌سنجی جرم‌انگاری فعالیت‌های ناظر بر محصولات تراریخته در ایران Feasibility of Criminalizing Activities Related to Genetically Modified Products in Iran مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: علم ژنتیک و عملیات دستکاری ژنتیکی، موضوع بسیار مهمی است که در سیر تکاملی خود از گیاهان و حیوانات فراتر رفته و با تحت تأثیر قراردادن ژن‌های انسان منجر به ایجاد آثار مهمی در حقوق اولیه بشر شده است. چنین فرآیندی بایستی به گونه‌ای تحقق پذیرد که هم دربرگیرنده دغدغه‌های اخلاقی و دینی باشد و هم موجبات حفاظت از موازین حقوق سلامت را فراهم آورد، لذا هدف این پژوهش امکان‌سنجی جرم‌انگاری فعالیت‌های ناظر بر محصولات تراریخته در ایران می‌باشد. روش: روش تحقیق به شیوه توصیفی ـ تحلیلی و با استفاده از منابع حقوقی و پزشکی مرتبط در این زمینه و با مد نظر قراردادن پژوهش‌های منتشرشده در سال‌های اخیر می‌باشد. ملاحظات اخلاقی: در نگارش این مقاله سعی شده است تمام اصول اخلاقی پژوهش و امانتداری رعایت شود. یافته‌ها: یافته‌های تحقیق نشان می‌دهد که علیرغم وجود مقرراتی در نظام حقوقی ایران هیچ یک از قوانین مذکور صراحتاً به جرم‌انگاری فعالیت‌های ناظر بر تولید یا عرضه محصولات تراریخته نپرداخته است، ولی بر اساس مبانی فقهی، اخلاقی، حقوقی و زیستی، محصولات تراریخته سلامت عمومی بشر را تهدید می‌کند. نتیجه‌گیری: در نظام کیفری ایران، هرچند برخی از مصادیق قابل انطباق با برخی عناوین مجرمانه از جمله «افساد فی ‌الارض»، «تسبیب در جنایات»، «اقدام علیه بهداشت عمومی» و... می‌باشد، ولی به دلیل اینکه چنین فعالیت‌هایی سلامت عمومی بشر را به طور گسترده در معرض خطر قرار می‌دهد، نیازمند تقنین از دوبعد پیشگیرانه و جرم‌انگاری می‌باشد.</div> <div style="text-align: justify;">Background and Aim: The field of genetics and genetic manipulation is a critically important issue that, in its evolutionary trajectory, has extended beyond plants and animals, affecting human genes and resulting in significant implications for fundamental human rights. Such processes must be carried out in a way that encompasses both ethical and religious concerns, while also safeguarding public health rights standards. Consequently, the objective of this study is to assess the feasibility of criminalizing activities related to genetically modified products in Iran. Methods: This research employs a descriptive-analytical methodology, utilizing relevant legal and medical sources in this domain, while also considering recent academic publications on the subject. Ethical Considerations: In the preparation of this paper, all research ethics and principles of academic integrity have been diligently observed. Results: The study’s findings indicate that, despite the presence of various regulations within Iran's legal framework, none of the existing laws explicitly criminalize activities related to the production or distribution of genetically modified products. However, based on principles of Islamic jurisprudence, ethical norms, legal foundations and biological evidence, genetically modified products pose a significant threat to public health.
