fa نظریه اصل محافظت از حق بر سلامت کودکان نسل آلفا در جهان آنلاین The Theory of the Principle of Protecting the Right to Health of Children of the Alpha Generation in the Online World مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حق بر سلامت از مهم‌ترین مصادیق حقوق کودکان می‌باشد. عوامل مختلفی در تهدید یا تحقق این حق کودکان مؤثرند که زیست‌بوم متاورس یکی از آن‌ها می‌باشد. «متاورس» جهانی نوظهور است. جهانی مجازی و سه‌بعدی که کاربران قادرند در آن از طریق آواتارها با یکدیگر ارتباط برقرار کنند. در واقع این تعاملات بشری است که با گذر زمان و پیشرفت فناوری‌های دیجیتال شکل تازه‌ای پیدا کرده و علم حقوق را با مسائل حقوقی بسیاری که بر افراد در شرایط متفاوت مؤثر است، مواجه کرده است. فارغ از مسائل حقوقی گوناگون مرتبط با متاورس، یکی از مسائل مهم در این زمینه جریان حمایت‌ از حق بر سلامت کودکان و کرامت انسانی آن‌ها در این زیست‌بوم است. این پدیده تکنولوژیک می‌تواند انقلابی در تربیت اجتماعی و رشد کودکان به‌ وجود آورده و هر دم موضوعی تازه در حمایت از حقوق کودکان ایجاد کند. این مقاله قصد دارد تا با این پرسش‌ها پاسخ دهد که چالش‌های تحقق حق بر سلامت کودکان در زیست‌بوم متاورس چیست؟ و بسترها و ابزارهای مورد نیاز جهت حمایت از حق بر سلامت کودکان در زیست‌بوم متاورس چیست؟ روش: این پژوهش بر آن است با روش توصیفی ـ تحلیلی و با بررسی اسناد، کتب و مرور مقالات و منابع پایگاه اطلاعاتی (Google Scholar) مقالات منتشرشده به زبان انگلیسی در سال‌های 24-2015 بودند که از طریق مرور ادبیات گسترده، تجزیه ‌و تحلیل، تحقیقات علمی و نظرات متخصصین و پژوهشگران و حقوقدانان پیشرو در این حوزه به دنبال درک ماهیت است. ملاحظات اخلاقی: در تدوین این مقاله جنبه‌های اخلاقی شامل حفظ اصالت متون، صداقت، رضایت و اطلاع‌رسانی رعایت شده است. یافته‌ها: باتوجه به اینکه اهمیت و تأثیر منفی دنیای مجازی در کودکان بر کسی پوشیده نیست، موضوع جدی حقوق کودکان در برابر این فناوری پرقدرت یکی از مباحث علمی و اجتماعی مهم این روزهاست. در این فضا با توجه به گستردگی دامنه آن، مخفی‌بودن هویت کاربران، سرعت بالا و فرامرزی‌بودن، فقدان مکانیزم اعمال صلاحیت و نظارت دولت‌ها می‌تواند بر حوزه‌ ادراک کاربران تأثیر عمیقی گذاشته و همه‌ ابنای بشر به خصوص کودکان و نوجوانان را با خطر مواجه کند. نتیجه‌گیری: نتیجه این بررسی، زمینه‌ای جهت نیل به هدف پژوهش، یعنی سازوکارها و چگونگی حمایت مؤثر از حق بر سلامت کودکان در زیست‌بوم متاورس شد. به‌ موجب این پژوهش، تمسک به بسترهای حقوقی و قانونی عام، همچنین توجه به قوانین خاص، بهره‌&lrm;مندی از هوش ‌مصنوعی و فناوری بلاکچین و تعریف و استفاده از ابزارهای ویژه، جهت حمایت‌های جامع از کودکان در محیط متاورس کارآمد خواهد بود.</div> <div style="text-align: justify;">Background and Aim: The "metaverse" is an emerging world a three-dimensional virtual environment where users can interact with one another through avatars. These human interactions, evolving with technological advancements, have introduced new dimensions to legal science by raising numerous legal issues that affect individuals under various circumstances. Among the diverse legal concerns surrounding the metaverse, one critical issue is the protection of children’s right to health and their human dignity within this ecosystem. This technological phenomenon has the potential to revolutionize children’s social development and growth, while continuously posing novel questions about safeguarding children’s rights. This article seeks to address the following questions: What are the challenges in realizing children’s right to health within the metaverse ecosystem? What are the necessary frameworks and tools required to support the right to health for children in this virtual environment? Methods: This research employs a descriptive-analytical method, reviewing documents, books, and articles published in the [Google Scholar] database. The study focuses on English-language articles from 2015 to 2024. It aims to understand the nature of the issue through extensive literature reviews, analyses, scientific research, and the insights of leading experts and legal scholars in this field. Ethical Considerations: Ethical principles, including maintaining the authenticity of texts, honesty, consent and transparency, were observed in the preparation of this article. Results: The significant impact and potential negative effects of the virtual world on children are widely acknowledged. Addressing children’s rights in the face of this powerful technology is one of the pressing scientific and social challenges of our time. Given the vast scope of the metaverse, the anonymity of users, its high speed, transnational nature and the absence of effective jurisdictional mechanisms and government oversight, this environment profoundly influences users’ perceptions and exposes all individuals, particularly children and adolescents, to significant risks. Conclusion: This study provides a foundation for achieving the research objective: Identifying effective mechanisms and strategies to protect children’s right to health in the metaverse ecosystem.
