fa بررسی تأثیر کاربست هوش مصنوعی در تشخیص بیماری‌های دهان و دندان بر مفهوم تقصیر دندان‌پزشک Investigating the Effect of Using Artificial Intelligence in the Diagnosis of Oral and Dental Diseases on the Concept of the Dentist's Fault مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: فناوری هوش مصنوعی (AI) به طور گسترده در دندان‌پزشکی کاربرد دارد. یک دندان‌پزشک می‌تواند از فناوری هوش مصنوعی جهت تحلیل داده‌های مربوط به بیمار، تشخیص و درمان بیماری‌های دهان و دندان و مدیریت فعالیت‌ها استفاده کند. ضرورت استفاده از نرم‌افزارهای جدید، واقعیاتی هستند که در علم دندان‌پزشکی از لحاظ آثار حقوقی و از جمله تأثیرات آن بر روی مفاهیم و ارکان مربوط به مسئولیت مدنی حائز اهمیت هست. یکی از مهم‌ترین سؤالات حقوقی در این بخش این است که ورود هوش مصنوعی چه تأثیراتی بر روی مفهوم تقصیر دارد. روش: این تحقیق از نوع نظری و به روش توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به روش کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در پژوهش حاضر جنبه‌های اخلاقی مطالعات کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری به طور کامل رعایت شده است. یافته‌ها: در این راستا با بررسی ماده 495 قانون مجازات اسلامی و مقررات خاص، تبیین هوش مصنوعی و کاربردهای آن در دندان‌پزشکی، این یافته‌ها حاصل شد که جدای از اینکه نمی‌توان برای هوش مصنوعی قائل به مسئولیت جداگانه بود، از آنجا که در استناد عرفی ضرر و رابطه سببیت تغییر ایجاد می‌شود، باید مفاهیم مربوط به مسئولیت مدنی، از جمله مفهوم تقصیر را در این موارد به شیوه جدید و با در نظرگرفتن مقتضیات امر بررسی کرد. نتیجه‌گیری: تفاوت‌های هوش مصنوعی با سایر ابزار از جهت استقلال در تصمیم‌گیری، تحلیل‌ها را متفاوت می‌کند. ممکن است نظام حقوقی تمایل به مسئول‌دانستن ماشین مبتنی بر تکنولوژی هوش مصنوعی داشته باشد، به نظر نگارنده، دشوار است که بتوان برای آن قائل به شخصیت حقوقی و مسئولیت جداگانه بود. زمانی که یک دندان‌پزشک به عنوان کاربر در فرآیند درمان، جهت تشخیص بیماری و یا در مراحل دیگر مربوط به درمان از نرم‌افزارهای هوشمند بهره می‌گیرد و در نتیجه آن آسیبی به بیمار وارد می‌شود، هرچند نمی‌توان برای این فناوری شخصیت حقوقی جداگانه قائل بود، لیکن از آنجا که در زنجیره به کارگیری آن افراد متعدد از جمله سازنده، آموزش‌دهنده یا کاربران متعدد دخیل هستند، از مسئولیت دندان‌پزشک می‌کاهد. از آنجا که عدم رعایت موازین فنی و علمی در اقدامات تشخیصی و درمانی مهم‌ترین معیاری است که در بررسی شکایات دندان‌پزشکی مورد استناد محاکم قضایی و هیأت‌های انتظامی قرار می‌گیرد، پس بعد از اطمینان از به رسمیت شناخته شدن استفاده از هوش مصنوعی در امر درمان در نمونه مورد نظر، باید بررسی گردد که شیوه درمانی به کارگرفته‌شده با استفاده از هوش مصنوعی، در علم دندان‌پزشکی مطابق مقررات متعارف پزشکی است یا خیر و معیار در تشخیص تقصیر دندان‌پزشک «رفتار پزشکی متعارف» است و این متعارف‌بودن باید در طرز استفاده از نرم‌افزار هوش مصنوعی نیز رعایت گردد.</div> <div style="text-align: justify;">Background and Aim: Artificial intelligence (AI) technology has wide applications in dentistry. A dentist can use AI technology to analyze patient data, diagnose and treat dental diseases and manage activities. The need for using new software and the legal implications, including civil liability, are important in the field of dentistry. One of the most important legal questions in this area is the impact of AI on the concepts and elements of civil liability. Methods: This research is a theoretical and descriptive analysis and the information was collected through library research and referring to documents, books and articles. Ethical Considerations: In this study, ethical aspects of library research, including authenticity of texts honesty and trustworthiness, were fully observed. Results: Examining Article 495 of the Islamic Penal Code and specific regulations, explaining artificial intelligence and its applications in dentistry, it was found that apart from the fact that AI cannot be held separately liable, since harm and causation relationship are established based on customary law, the concepts related to civil liability, including the concept of fault, causation relationship, etc., should be examined in these cases in a new way and considering the necessary considerations. Conclusion: The differences of artificial intelligence with other tools in terms of independence in decision-making and analysis make the difference. The legal system may tend to consider AI-based machine as responsible, but in the author opinion, it is difficult to attribute separate legal personality and liability to it. When a dentist, as a user, uses intelligent software for diagnosis or other treatment stages and as a result, harm is caused to the patient, although separate legal personality cannot be attributed to this technology, it reduces the liability of the dentist since multiple individuals, including the creator, trainer, or multiple users, are involved in the chain of its deployment.
