fa جایگاه حقوق بین‌الملل سلامت در بلایا با تأکید بر استانداردهای مطلوب حاکمیت سرزمینی The Position of International Health Law in Disasters with an Emphasis on the Optimal Standards of Territorial Governance مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: به دنبال وقوع بلایا که آثار مخرب شدیدی بر سلامت انسان و محیط زیست دارند، نحوه مقابله با بلایا و نحوه عملکرد دولت در حمایت از حق بر سلامت نیز در چنین زمانی مطرح می‌گردد. هر دولتی موظف است تمام تلاش خود را برای جلوگیری از آسیب و کاهش خطر ناشی از بلایا انجام دهد. چنین امری میسر نخواهد شد مگر با اتخاذ اقدامات مقتضی از جانب دولت متأثر و همچنین سایر بازیگران و کشورهای کمک‌کننده. آن‌گونه که در طرح 2016 کمیسیون حقوق بین‌الملل در مورد حمایت از اشخاص در زمان وقوع بلایا نیز این مسأله مورد توجه قرار گرفته است. بنابراین برای اینکه یک دولت عملکرد خوبی در زمان وقوع بلایا داشته باشد، موظف است یکسری از اصول و قواعد را رعایت نماید تا از حقوق اشخاص آسیب‌دیده به ویژه حق بر سلامت حمایت نماید. بنابراین با یک روش تحلیلی ـ توصیفی در مقاله حاظر مشخص خواهد شد که چگونه می‌توان از طریق شاخص‌های حکمرانی مطلوب از حق بر سلامت اشخاص آسیب‌دیده حمایت کرد؟ آنچه از یافته‌های این پژوهش برمی‌آید، این است که از نظر کمیسیون تکلیف به همکاری میان کشورها در زمان بحران به عنوان معیاری از حکمرانی مطلوب، می‌تواند به عنوان راه حلی برای مقابله با بلایا و تضمین هرچه بیشتر حقوق بشر به ویژه حق بر سلامت اشخاص آسیب‌دیده گردد. روش: این مقاله به روش توصیفی ـ تحلیلی نوشته شده است. روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در پژوهش حاضر جنبه‌های اخلاقی مطالعه کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: آنچه از یافته‌های این پژوهش برمی‌آید، این است که از نظر کمیسیون تکلیف به همکاری میان کشورها در زمان بحران به عنوان معیاری از حکمرانی مطلوب، می‌تواند به عنوان راه حلی برای مقابله با بلایا و تضمین هرچه بیشتر حقوق بشر به ویژه حق بر سلامت اشخاص آسیب‌دیده گردد. نتیجه‌گیری: اینکه یک دولت قبل، حین و بعد از وقوع بلایا باید چه اقدام‌هایی انجام دهد تا از آسیب‌های داخلی یا فرامرزی جلوگیری، متوقف و جبران کند، از تعهدات به هم پیوسته یک دولت محسوب می‌گردد که در صورت عملکرد خوب و واکنش به موقع دولت متأثر و همکاری سایر تابعان حقوق بین‌الملل، منجر به رسیدن هدف غایی که همان حفظ و حمایت از کرامت ذاتی انسان است، در قالب حکمرانی مطلوب اتفاق خواهد افتاد.</div> <div style="text-align: justify;">Background and Aim: In the aftermath of disasters that have severe detrimental effects on human health and the environment, the strategies for disaster response and the role of government in safeguarding the right to health become critical issues. It is the responsibility of every government to exert all possible efforts to prevent harm and mitigate risks associated with disasters. This objective can only be achieved through the implementation of appropriate measures by the affected state, as well as by other stakeholders and assisting nations. This concern is also highlighted in the 2016 draft by the International Law Commission regarding the protection of persons in the event of disasters. Consequently, for a state to perform effectively in times of disaster, it must adhere to a set of principles and regulations that protect the rights of affected individuals, particularly the right to health. This paper will employ an analytical-descriptive approach to elucidate how the right to health of affected individuals can be supported through indicators of good governance. The findings of this research suggest that the obligation for cooperation among countries during crises, as a criterion of good governance, can serve as a viable solution for disaster management and the enhancement of human rights, especially the right to health for those impacted. Methods: This article is composed using a descriptive-analytical approach. The data collection method employed is library-based, involving the examination of documents, books and articles. Ethical Considerations: In the present study, the ethical aspects of library research have been addressed, encompassing the authenticity of texts, integrity and the principles of trustworthiness. Results: The findings of this research indicate that the obligation for cooperation among states during times of crisis, as recognized by the commission, serves as a criterion for effective governance. This obligation can be viewed as a potential solution for addressing disasters and ensuring the protection of human rights, particularly the right to health for affected individuals. Conclusion: The responsibilities of states before, during and after the occurrence of disasters encompass a range of actions aimed at preventing, halting and compensating for both domestic and transnational damages.
