fa نقش نظام حقوقی در پیشگیری از قصور و جرائم پزشکی The Role of the Legal System in Preventing Medical Malpractice and Crimes مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: پیشگیری از وقوع جرائم و تخلفات یکی از مهم‌ترین دغدغه‌های نظام حقوقی و راهبرد اصلی سیاست جنایی می‌باشد که به تبع پیشگیری از قصور و جرائم پزشکی نیز جزئی از این راهبرد است. در جهت نیل به این هدف، نظام حقوقی، قوانینی در سطح فراتقنینی، عادی و مقررات دولتی مورد تصویب قرار داده است، لیکن با توجه به تحولات سریع اجتماعی، رشد سریع تکنولوژی و ظهور بیماری‌های جدید، ضرورت اصلاح قوانین و مقررات در پیشگیری از جرائم و تخلفات پزشکی را همگام با این تحولات ناگزیر می‌نمایاند. روش: مقاله حاضر با بهره‌گیری از کتب و مقالات علمی معتبر داخلی و خارجی و استفاده از روش مطالعه و بهره‌گیری از تجربه قضایی جهت تبیین نقش رویه قضایی محاکم قضایی در پیشگیری از قصور و جرائم پزشکی به رشته تحریر درآمده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: در این رویکرد ضرورت دارد نظام حقوقی با بهره‌گیری از ظرفیت‌های حقوقی و فقهی موجود در حقوق داخلی، ضمن خوانش جدید از مبانی نظام مسئولیت کیفری و مدنی جامعه پزشکی زمینه‌های بازدارندگی ارتکاب تخلفات و جرائم پزشکی را فراهم آورد. نتیجه‌گیری: نظام حقوقی می‌تواند با بهره‌گیری از آموزه‌های جرم‌شناسی پیشگیری و سیاست‌های نوین جنایی نظام قانونگذاری را در ابعاد تقنینی و قضایی (ایجاد رویه) به اتخاذ سیاست‌ها و تدابیر پیشگیرانه از جرائم و تخلفات پزشکی رهنمون سازد.</div> <div style="text-align: justify;">Background and Aim: Prevention of crimes and violations is one of the most important concerns of the legal system and the main strategy of the criminal policy, which, accordingly, prevention of malpractice and medical crimes is also a part of this strategy. In order to achieve this goal, the legal system has approved laws at the extra-legislative level, normal and government regulations, but due to the rapid social changes, the rapid growth of technology and the emergence of new diseases, the need to amend laws and regulations in the prevention of crimes and medical malpractices are inevitable along with these developments. Methods: This article has been written by using valid domestic and foreign scientific books and articles and using the study method and using judicial experience to explain the role of judicial procedure in the prevention of malpractice and medical crimes. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: In this approach, it is necessary for the legal system to take advantage of the existing legal and jurisprudential capacities in the domestic law, while providing a new reading of the basics of the criminal and civil liability system of the medical community to prevent the commission of medical violations and crimes.
