fa جرائم علیه سلامت و تمامیت جسمانی در متاورس مقاله پژوهشي Original Article <span style="font-family:Tahoma;"><span style="font-size:14px;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#101b34">زمینه و هدف:</span></span></span></b> <span lang="FA"><span b="" nazanin="">جهان متاورس در تمامی ابعاد، می‌تواند زندگی فرد را تحت پوشش قرار دهد. نماد حضور وی در این جهان در قالب آواتار به مثابه نگاره دیجیتالی او است که با هدست‌های مجای به جهان متاورس وارد می‌شود. در زمان حضور وی در متاورس، امکان این وجود دارد که فرد غرق آن جهان شده و نتواند تعادل خود را از نظر جسمی حفظ کند. در این صورت، چه‌بسا دچار جراحت جسمانی شود یا به دلیل حضور افراطی در این جهان، از زندگی واقعی دور مانده و دچار اعتیاد به زندگی مجازی یا مشکلات حرکتی و بینایی و... شود. از دیگرسو ممکن است با مواردی از جرائم علیه خود در جهان متاورس مانند قتل یا تعرض مواجه گردد که از نظر روحی توانایی مواجهه با آن را نداشته و دچار مشکلات و آسیب‌های جدی روحی ـ روانی مانند اختلال اضطراب پس از حادثه گردد، لذا وقوع این قبیل جرائم در متاورس علیه افراد می‌تواند آسیب‌زا و نگران‌کننده باشد. در قانون جزا جرائم علیه تمامیت جسمانی دارای مجازات است، لکن این مجازات‌ها مربوط به جرائم فضای واقعی می‌باشد. بنابراین رفتارهایی مانند تعرض یا کشتن آواتار یک فرد در متاورس مجازاتی نخواهد داشت و به نظر می‌رسد جرائمی که در دنیای متاورس رخ می‌دهد و یک آسیب فیزیکی مجازی با پیامدهای دنیای واقعی محسوب می‌شود، بدون مجازات می‌مانند. نقطه‌ای که خلأ قانونی آن می‌تواند ابزار سوءاستفاده مجرمین و آسیب‌پذیری افراد را فراهم آورد.</span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#101b34">روش:</span></span></span></b> <span lang="AR-SA"><span b="" nazanin="">برای این پژوهش از منابع انگلیسی سال‌های اخیر استفاده شده است که از طریق ارتباط مفاهیم فنی متاورس و حقوق کیفری در حوزه جرائم علیه اشخاص با تجزیه و تحلیل انجام شده است.</span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#101b34">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span b="" nazanin="">در تمام مراحل نگارش پژوهش حاضر ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#101b34">یافته‌ها:</span></span></span></b><span lang="AR-SA"><span b="" nazanin=""> یافته‌ها حاکی از آن است جرائمی که در دنیای متاورس رخ می‌دهد، با نظام حقوق کیفری فعلی قابلیت مصداق‌سنجی و کیفردهی ندارد و ضرورت ورود حقوق کیفری به این فضا کاملاً ملموس می‌باشد.</span></span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#101b34">نتیجه‌گیری:</span></span></span></b> <span lang="FA"><span b="" nazanin="">وجود قوانین مربوط به جرائم علیه تمامیت جسمانی جهت تضمین سلامت جسمی و روانی افراد مربوط به جهان متاورس ضرورت دارد تا جرائم این فضا کمتر شده و ایمنی آن افزایش یابد.</span></span></span></span></span></span></span></span> <span style="line-height:2;"><span style="font-family:Tahoma;"><span style="font-size:14px;"><span style="background:#f7f7f7"><b><span new="" roman="" times=""><span style="color:#101b34">Background and Aim:</span></span></b><span new="" roman="" times=""> Metaverse world can cover a person&#39;s life in all dimensions. The symbol of his presence in this world is in the form of an avatar, as a digital picture of him, which enters the metaverse world with a headset. During his presence in the metaverse, there is a possibility that the person is immersed in that world and cannot maintain his physical balance. In this case, he may suffer a physical injury or, due to his extreme presence in this world, he may stay away from real life and become addicted to virtual life or movement and vision problems, etc. On the other hand, he may face cases of crimes against him in the metaverse world, such as murder or assault, which he is not mentally capable of facing and may suffer serious mental-psychological problems and injuries, such as anxiety disorder after the accident. Therefore, the occurrence of such crimes in Metaverse against people can be traumatic and worrying. In the criminal law, crimes against physical integrity have punishments, but these punishments are related to real space crimes. Therefore, behaviors such as assaulting or killing a person&#39;s avatar will not be punished in the metaverse and it seem that crimes that occur in the metaverse and are considered a virtual physical injury with real world consequences remain unpunished.
