fa بررسی تنقیحی مجازات‌های «اعدام» و «حبس دائم با اعمال شاقه» در جرم تقلب در تهیه مواد دارویی Study of Penalties for Drug Fraud; "Death Penalty" and "Life Imprisonment with Forced Labour" مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: به موجب ماده 18 «قانون مربوط به مقررات امور پزشکی و دارویی و مواد خوردنی و آشامیدنی» مصوب 1334، کسانی که به نحوی مرتکب تقلب در تهیه مواد دارویی می‌شوند، حسب نتیجه حاصله مستوجب مجازات‌های «اعدام»، «حبس دائم با اعمال شاقه»، «حبس تأدیبی» یا «حبس مجرد» می‌باشند. در نظم حقوقی کنونی، مجازات‌های «حبس دائم با اعمال شاقه» وجود ندارند و «اعدام» نیز مجازات خاص حدود می‌باشد. با توجه به این تغییرات اساسی در نظام جرائم و مجازات‌ها و در مقام انطباق مجازات‌های احکام کیفری معتبر پیش از انقلاب با «قانون مجازات اسلامی» مصوب 1392، تعیین وضعیت اعتبار جرم تقلب در تهیه مواد دارویی و مجازات‌های آن اهمیت دارد. روش: این تحقیق بیش از هر چیز، رویکرد «تنقیحی» دارد و با مراجعه مستقیم به احکام قانونی در رابطه با تقلب در مواد دارویی و مجازات‌های آن، حکم قانونی معتبر در این خصوص را تشخیص و رابطه آن را با آخرین تغییرات در نظام جرائم و مجازات‌ها در قانون مجازات اسلامی نشان می‌دهد. بنابراین منبع اصلی در این تحقیق، قوانین مرتبط از ابتدای تاریخ قانونگذاری می‌باشد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: با توسل به اصل بقای اعتبار قوانین و عدم نسخ آن‌ها و با توجه به اینکه دلایل کافی برای نسخ کامل ماده 18 فوق‌الذکر وجود ندارد، ماده مذکور در نظام حقوقی ایران معتبر است. با این وجود مجازات «اعدام» و «حبس ابد با اعمال شاقه» مندرج در ماده مذکور با نظم حاصل از اجرای قانون مجازات اسلامی مصوب 1392 همخوانی ندارد. نتیجه‌گیری: با توجه به تحولات اساسی نظام جرائم و مجازات‌ها، ضرورت دارد که قانونگذار مشابه تصمیمی که در خصوص مجازات‌های «اعدام» و «حبس ابد» در «قانون الحاق یک ماده به قانون مبارزه با مواد مخدر» مصوب 12/7/1396 و مجازات «حبس ابد» در ماده 3 «قانون کاهش مجازات حبس تعزیری» مصوب 23/2/1399 اتخاذ نموده، برای مجازات‌های «اعدام» و «حبس دائم» در ماده 18 «قانون مربوط به مقررات امور پزشکی و دارویی و مواد خوردنی و آشامیدنی» مصوب 1334 نیز اتخاذ نماید.</div> <div style="text-align: justify;">Background and Aim: According to the article 18 of the "Act on Medical and Pharmaceutical Affairs and Food and Beverage Regulations" approved in 1955, those who somehow commit fraud in the preparation of pharmaceuticals, will be subject to the punishments of "Death Penalty", "Life Imprisonment with Forced Labour", "disciplinary imprisonment" and etc. In the current legal system, there are no punishments such as "Life Imprisonment with Forced Labour" and "Death Penalty" is a specific punishment. Therefore, considering the fundamental changes that have occurred in the system of crimes and punishments and in terms of the conformity of the punishments of the valid criminal sentences before the Islamic Revolution with the "Islamic Penal Act" approved in 2012, it is important to determine the validity of the crime of fraud in the preparation of medicinal substances and its punishments. Methods: Above all, this research has a "codifying" approach And by referring directly to the legal rulings related to the fraud in medicinal substances and its punishments, it recognizes the valid legal ruling in this regard and shows its relationship with the latest changes in the system of crimes and punishments in the "Islamic Penal Act". Therefore, the main source in this research is related Acts from the beginning of legislative history. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: By appealing to the principle of the validity of the laws and their non-repeal, and considering that there are no sufficient reasons for the complete repeal of the Article 18, this article is valid in the Iranian legal system. However, the punishment of "Death Penalty" and "Life Imprisonment with Forced Labour" mentioned in the article 18, is not consistent with the Islamic Penal Code approved in 2012.
