fa امکان‌سنجی مسئولیت مدنی ناشی از کاربست هوش مصنوعی در حیطه پزشکی Feasibility Study of the Civil Liability of Artificial Intelligence Due to Damage in Medical Law مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: گسترش دانش در حوزه پزشکی و پیچیدگی تصمیمات مرتبط با آن توجه متخصصین را به استفاده از سیستم‌های هوشمند جلب نموده است. هوش مصنوعی در تشخیص بیماری‌ها، پیش‌بینی نتایج درمانی، نرم‌افزارهای پشتیبان بیمار و پزشک، تحلیل داده‌های پزشکی و پیشگیری از بیماری‌ها و... به کار می‌آید و این کار از طریق شبیه‌سازی، تقویت و یا تکمیل هوش انسانی به روش دقیق و کارآمد انجام می‌شود. این سازوکار پدیده جدیدی است که حقوق خصوصی را درگیر چالش جدیدی در بحث مسئولیت مدنی می‌کند که برای پاسخگویی به آن‌ها مجبور به اصلاح یا ایجاد سازوکارهای حقوقی و قانونی جدید هستیم. سیستم‌های هوش مصنوعی ممکن است علت مستقیم یا غیر مستقیم آسیب به بیمار باشد، لذا پژوهش حاضر ضمن بررسی چگونگی کاربست فناوری هوش مصنوعی در عرصه پزشکی درصدد پاسخ به این سؤال است که آیا می‌توان برای هوش مصنوعی در مقام یک شخص حقوقی در قبال آسیب‌های وارده به بیمار مسئولیت قائل بود؟ روش: برای این تحقیق از منابع فارسی و انگلیسی استخراج‌شده از سایت‌های معتبر به خصوص مقالات 22-2015 استفاده شده است که از طریق تجزیه، تحلیل، تحقیقات علمی و نظرات افراد متخصص در زمینه هوش مصنوعی و حقوقدانان انجام شده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش حاکی از آن است پزشک معالج وقتی با به کارگیری هوش مصنوعی به تشخیص و درمان می‌پردازد؛ از آنجا که در استناد عرفی ضرر و رابطه سببیت تغییر ایجاد می‌شود، مسئولیت مدنی هوش مصنوعی بر مبنای تئوری‌های مختلف از جمله شخصیت حقوقی مستقل، تلقی به عنوان حیوان یا شئ قابل بررسی است. نتیجه‌گیری: وقتی پزشک معالج به عنوان کاربر از هوش مصنوعی در فرآیند درمان بهره می‌برد و در نتیجه آن آسیبی به بیمار وارد می‌شود، هرچند نمی‌توان برای این فناوری شخصیت حقوقی جداگانه قائل بود، لیکن از آنجا که در زنجیره به کارگیری آن افراد متعدد از جمله سازنده، آموزش‌دهنده یا کاربران متعدد دخیل هستند از مسئولیت پزشک می‌کاهد.</div> <div style="text-align: justify;">Background and Aim: The expansion of knowledge in the field of medicine and the complexity of related decision-making has drawn the attention of experts to the use of intelligent systems. Artificial intelligence is used in disease diagnosis, prediction of treatment outcomes, patient and physician support software, medical data analysis, and disease prevention. This is achieved through simulation, enhancement or augmentation of human intelligence in a precise and efficient manner. This new phenomenon raises new challenges in the discussion of civil liability, which necessitates the modification or establishment of new legal mechanisms to address them. AI systems may directly or indirectly cause harm to patients. Therefore, this research aims to investigate how artificial intelligence technology is applied in the medical field and seeks to answer the question of whether artificial intelligence can be held legally responsible as a legal entity for the damages caused to patients. Methods: For this study, Persian and English sources extracted from reputable websites, especially articles from 2015-22, have been utilized. The research has been conducted through decomposition, analysis, scientific research, and the opinions of experts in the field of artificial intelligence and legal experts. Ethical Considerations: The research upholds authenticity, honesty and fidelity in organizing the study. Results: The research findings indicate that when a physician uses artificial intelligence for diagnosis and treatment, the application of AI can change the traditional notions of liability and causation. The civil liability of artificial intelligence can be based on various theories, including independent legal personality, consideration as an animal or an object subject to examination, due to the changes in customary law and causation.
