fa امکان‌سنجی تأثیر نوسانات خُلقی پیش از قاعدگی در مرحله دادرسی و صدور حکم؛ یک مطالعه تطبیقی Feasibility Assessment of the Effect of Premenstrual Mood Swings in the Trial and Sentencing Stage; A Comparative Study مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: قاعدگی یکی از ویژگی‌های اختصاصی بانوان است و باعث ایجاد نوسانات خلقی در بانوان چه قبل و چه حین این دوران ‌می‌شود. سؤالی که در این نوشتار نویسندگان به دنبال پاسخ‌دهی هستند، این است که آیا ‌می‌شود مبنایی پیدا نمود تا نوسانات خلقی نشانگان پیش از قاعدگی یا به تعبیر دیگر سندرُم پی‌ام‌اس (PMS) به عنوان یکی از کیفیات مخففه قضایی تلقی شود یا خیر؟ پژوهش حاضر با هدف شناخت و مطالعه امکان‌سنجی پذیرش تأثیر نوسانات خلقی ناشی از نشانگان پی‌ام‌اس و نقش احتمالی آن در کاهش مسئولیت کیفری به عنوان یک کیفیات مخففه قضایی انجام شده است. روش: پژوهش حاضر از نظر هدف کاربردی محسوب ‌می‌شود. روش تحقیق با در نظرگرفتن نوع و ماهیت آن و شیوه جمع‌آوری داده‌ها از نوع توصیفی ـ تحلیلی و مبتنی بر مطالعات کتابخانه‌ای با رویکردی تطبیقی به رویه قضایی برخی کشورهای دارای نظام حقوقی کامن‌لا است. ملاحظات اخلاقی: ﺩﺭ ﭘﮋﻭﻫﺶ ﺣﺎﺿﺮ ﺟﻨﺒﻪﻫﺎﻱ ﺍﺧﻼﻗﻲ ﻣﻄﺎﻟﻌﻪ ﻛﺘﺎﺑﺨﺎﻧﻪﺍﻱ ﺷﺎﻣﻞ ﺍﺻﺎﻟﺖ ﻣﺘﻮﻥ، ﺻﺪﺍﻗﺖ ﻭ ﺍﻣﺎﻧﺘﺪﺍﺭﻱ ﺭﻋﺎﻳﺖ ﺷﺪﻩ ﺍﺳﺖ. یافته‌ها: هیچ ادله محکمی مبنی بر اثبات اینکه نشانگان پیش از قاعدگی موجب ارتکاب جرم ‌می‌گردد، وجود ندارد، اما اگر بپذیریم نشانگان پیش از قاعدگی بر تاب‌آوری و رواداری گروهی از زنان اثر می‌گذارد، در این صورت بررسی چگونگی بهره‌گیری از این ادله در دادرسی‌های کیفری و به ویژه در مرحله کیفرگذاری امری به جاست. واقعیت این است که ادله نشانگان پیش از قاعدگی به عنوان یک دفاع مبتنی بر فقد عنصر روانی جای نمی‌گیرند، لذا باور نویسندگان بر این است که این ادله نمی‌توانند مبنایی برای یک عذر معاف‌کننده خاص و جدید مرتبط با جنسیت زنان ایجاد کنند. نتیجه‌گیری: شایسته این است با لحاظ تئوری مسئولیت کیفری نقصان‌یافته و به تبع آن استفاده از نهادهای ارفاقی به سوی یک حکم محکومیت انعطاف‌پذیرتر گرایش داشته باشیم. از این رو سزاوار است نشانگان پیش از قاعدگی در مرحله صدور حکم مجازات مد نظر مقنن ایرانی جهت اصلاح ماده 38 قانون مجازات اسلامی قرار گیرد.</div> <div style="text-align: justify;">Background and Aim: Menstruation is one of the specific characteristics of women and causes mood swings in women both before and during this period. The question that the authors seek to answer in this article is whether it is possible to find a basis to consider the mood swings of PMS syndrome as one of the qualities of the judicial abbreviation or not? The current research was conducted with the aim of recognizing and studying the feasibility of accepting the impact of mood swings caused by PMS syndrome and its possible role in reducing criminal liability as a judicial mitigating factor. Methods: The present article is considered practical in terms of its purpose. Considering the type and nature of research and data collection methods, it is descriptive-analytical and based on library studies. Ethical Considerations: In the present article, the ethical aspects of library study, including the authenticity of texts, honesty and trustworthiness, have been observed. Results: There is no solid evidence to prove that premenstrual syndrome causes crime. But if we accept that premenstrual syndrome affects the resilience and tolerance of a group of women, then it is appropriate to examine how to use this evidence in criminal proceedings, especially in the sentencing stage. The fact is that evidence of premenstrual syndrome does not fit as a defense based on the lack of mens rea. Therefore, the authors believe that these evidences cannot create a basis for a special and new excusing exempt related to women's gender. Conclusion: In terms of the theory of diminished criminal responsibility and accordingly the use of lenity-based foundations, it is appropriate to tend towards a more flexible sentencing verdict; therefore, it is appropriate to consider premenstrual syndrome in the sentencing phase of the Iranian legislator to amend Article 38.
