fa ضرورت کاربست اصول بنیادین حقوق کیفری در رسیدگی به جرائم پزشکی The Necessity of Applying the Fundamental Principles of Criminal Law in Dealing with Medical Crimes مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: اصول شکلی و ماهوی پذیرفته‌شده در حقوق کیفری خصوصاً وقتی با اوصاف بنیادین و اساسی همراه است، شاکله اصلی نظام حقوقی هر کشور را تشکیل می‌دهند. پذیرش چنین اصولی مورد تأکید آموزه‌های حقوق بشری و حقوق داخلی و بین‌المللی می‌باشد. این اصول که ریشه در اعتقادات داشته و دارای پشتوانه‌ها و مبانی مستحکم می‌باشد، نه‌تنها در رسیدگی‌های کیفری، بلکه در رسیدگی‌های مراجع مختلف اعم از حقوقی، اداری و انتظامی نیز می‌بایست مورد توجه و تأکید باشند. روش: پژوهش حاضر با روش توصیفی ـ تحلیلی و از طریق جمع‌آوری مطالب با استفاده از شیوه کتابخانه‌ای صورت پذیرفته است. ملاحظات اخلاقی: در تمام مراحل پژوهش، سعی شده است امانتداری علمی رعایت شده باشد. یافته‌ها: جرائم پزشکی و قصور در درمان، از جمله موضوعاتی است که در هیأت‌های بدوی و تجدید نظر سازمان نظام پزشکی به آن رسیدگی و پس از برخوردهای انتظامی با پزشک یا کادر درمان، نهایتاً نتیجه در مراجع قضایی مورد استفاده قرار می‌گیرد. نویسندگان در پژوهش حاضر، قوانین حاکم بر رسیدگی‌های انتظامی در حوزه پزشکی را از حیث توجه به اصول بنیادین حقوق کیفری مورد رصد و ارزیابی قرار داده و مشخصاً موارد عدول یا کم‌توجهی به این اصول را مورد شناسایی قرار دادند. نتیجه‌گیری: رعایت برخی اصول بنیادین در حقوق کیفری از چندان اهمیتی برخوردار است که می‌بایست در رسیدگی‌های مراجع اداری و انتظامی نیز مورد تأکید قرار گیرد. کم‌توجهی به برخی از این اصول شائبه، عدول از دادرسی منصفانه را به ذهن طرفین دعوی متبادر ساخته و نارضایتی عمومی ایجاد می‌کند، به نحوی که پس از مدتی شاهد عدم مراجعه و انصراف افراد بزه‌دیده و زیان‌دیده برای احقاق حقوق خود هستیم. بدیهی است اصول بنیادین حقوق کیفری نه‌تنها باید در عمل رعایت شود، بلکه نمود و بروز آن در قوانین به نحوی باید باشد که قابلیت استناد داشته باشد و ضمانت اجراهایی برای عدم رعایت آن‌ها پیش‌بینی شود، لذا ضرورت دارد در خصوص برخی از اصول بنیادین حقوق کیفری، ملاحظاتی در قوانین موجود در زمینه حقوق پزشکی منعکس شود.</div> <div style="text-align: justify;">Background and Aim: Formal and substantive principles accepted in criminal law, especially when they are associated with fundamental and essential features, form the main structure of the legal system of any country. The acceptance of such principles is emphasized by the doctrines of human rights and domestic and international law. These principles, which are rooted in beliefs and have strong foundations, should be emphasized not only in criminal proceedings, but also in the proceedings of various authorities, including legal, administrative and police. Methods: The present research was carried out with a descriptive analytical method and by collecting materials using the library method. Ethical Considerations: In all stages of the research, it has been tried to observe scientific trustworthiness. Results: Medical crimes and malpractice in treatment are among the issues that are dealt with in the primary and appeal boards of the medical system organization, and after disciplinary encounters with the doctor or treatment staff, the result is finally used in judicial authorities. In the current study, the authors observed and evaluated the laws governing criminal proceedings in the field of medicine in terms of paying attention to the fundamental principles of criminal law and specifically identified the cases of violation or lack of attention to these principles. Conclusion: Compliance with some basic principles in criminal law is very important, which should be emphasized in the proceedings of administrative and law enforcement authorities. Lack of attention to some of these dubious principles leads to the avoidance of fair proceedings in the minds of the litigants and creates public dissatisfaction. In such a way that after some time we see that the aggrieved and damaged people do not come and withdraw to claim their rights. It is obvious that the fundamental principles of criminal law must not only be observed in practice, but also its appearance and manifestation in the laws should be in such a way that it can be cited and the guarantee of executions for non-compliance should be foreseen.
