fa ضرورت برچسب‌زداییِ مجرمانه از بیماران روانی و تسهیلگران خانوادگی، در رویکرد سیاست جنایی به اورژانس اجتماعی Necessity of Decriminal Labeling on Mental Patients and Family Facilitators, in the Criminal Policy Approach to "Social Emergency Service" مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حفظ کرامت انسانی مبتلایان به اختلالات روانی و خانواده‌ آن‌ها ایجاب می‌کند تدابیر سیاست جنایی، جرم‌انگاری، مجرم‌پنداری و روندهای قانونی و اداریِ خدمات اورژانس اجتماعی، اصلاح گردد، از جمله تعدیل سازوکار قضایی مراجعه به کلانتری برای طرح شکایت و پس‌ از آن اخذ حکم قضایی دادگاه و مراجعه مجدد به کلانتری برای تسلیم حکم به مقام مسئول کلانتری، از حیث مغایرت با اصل سرعت و کرامت جهت مداخله در بحران رفتار متشنجِ بیماران روانی، محل تأمل و نقد است. روش: در این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در پژوهش حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: گروه درمان اعزامی اورژانس اجتماعی شامل پرستار، مددکار، دو نفر نیروی انسانی برای کنترل بیمار در صورت لزوم و یک مأمور ناجا با لباس شخصی پس از تماس خانواده بیمار با اورژانس اجتماعی به ‌جای اعزام همزمان آمبولانس و خودروی ناجا با داشتن حکم قضایی، به محل اعزام شوند و فرد را در شرایط عود بیماری به بیمارستان منتقل کنند تا علاوه بر حفظ کرامت انسانی بیمار و خانواده وی، مانع تشدید مخاطره جانیِ بیمار و اطرافیان وی در شرایط حساس تنش روانی و قلدری فیزیکیِ بیمار شوند و از انگ روان‌رنجوری و مجرمانگی بر بیمار و خانواده‌ پیشگیری شود. کاهش بوروکراسی اداری ـ درمانی و چابک‌سازی زنجیره فرایند بعدیِ قضایی، از جمله دیگر محاسن این فرضیه راهکارمحورِ پیشنهادی است. نتیجه‌گیری: روند طولانی کنونی برای انتقال روان‌رنجورانِ پرمخاطره از منزل به مراکز درمانی و مراقبتی، از منظر یافته‌های دانش جرم‌شناسی بالینی نیازمند تغییر فرایند انتقال و تغییر کنشگران متولی انتقال می‌باشد. در غیر این صورت، بزه‌دیدگیِ پرسنل اورژانس اجتماعی و خانواده بیمار، تداوم می‌یابد و روابط سازمان بهزیستی، قوه قضاییه و ناجا در ارائه خدمات بالینی ـ انتظامی در این مهم همچنان نامنقّح و مشوش خواهد بود.</div>   <div style="text-align: justify;">Background and Aim: Preservation of the human dignity of people suffering from mental disorders and their families requires that criminal policy measures, criminalization, criminalization and legal and administrative processes of social emergency services be modified. Among the necessary reforms are: Adjusting the judicial mechanism of going to the police station to file a complaint and then obtaining a court order and returning to the police station to submit the order to the police officer. These can be criticized in terms of contradicting the principle of speed and dignity in order to intervene in the crisis of tense behavior of mental patients. Methods: This research is of a theoretical type, the research method is descriptive and analytical and the method of collecting information is library-based, referring to documents, books and articles. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: The social emergency dispatch treatment group includes a nurse, a worker, two human resources to control the patient if necessary and a rescue officer in uniform after the patient's family contacted the social emergency instead of sending an ambulance and a rescue vehicle to the place at the same time with a court order. be dispatched and transfer the person to the hospital in case of relapse of the disease, in addition to preserving the human dignity of the patient and his family, prevent the escalation of the danger to the life of the patient and those around him in sensitive situations of mental stress and physical bullying of the patient, and from the stigma of neuroticism and criminality on the patient and family to be prevented. Reduction of administrative-medical bureaucracy and making the chain of the next judicial process more agile are among other advantages of this proposed solution. Conclusion: The current long process of transferring high-risk neuroses from home to treatment and care centers, from the perspective of the findings of clinical criminology, requires changing the transfer process and changing the actors in charge of the transfer.
