fa نقش حقوق کیفری در تضمین حق تغذیه در کشورهای توسعه‌یافته و در حال توسعه The Role of Criminal Law in Ensuring the Right to Food in Developed and Developing Countries مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امنیت غذایی یکی از معیارها و لوازم توسعه انسانی است. حق دسترسی به غذای کافی و سالم از محورهای اصلی توسعه، سلامت جامعه و زیرساخت‌های نسل‌های آینده است. در این راستا حقوق کیفری می‌تواند مجموعه‌ای از ابزارها را برای تضمین این حق فراهم نماید. این پژوهش به نحو تطبیقی به بررسی تأثیرات حقوق کیفری بر تضمین حق تغذیه در کشورهای توسعه‌یافته و در حال توسعه می‌پردازد. هدف اصلی، مقایسه سیاست‌ها، قوانین و سازوکارهای حقوق کیفری متداول در این دو دسته کشورها به منظور ارتقای حقوق غذایی و نهادهای ناظر در حوزه امنیت غذایی و پیشگیری از سوءتغذیه است. روش: این پژوهش با بهره‌گیری از منابع حقوقی مختلف به روش تحلیلی ـ تطبیقی و با تکیه بر منابع کتابخانه‌ای نگارش یافته است. ملاحظات اخلاقی: در این پژوهش ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: در این پژوهش، یافته‌ها نشان‌دهنده تفاوت‌های عمده در ساختارهای حقوق کیفری مرتبط، میزان و نوع سیاستگذاری و همکاری‌های بین‌المللی در سطح کشورها است. نتیجه‌گیری: در حالی که کشورهای توسعه‌یافته بهره‌مند از سازوکارهای پیشرفته و توانمند در تضمین دسترسی به تغذیه سالم هستند، کشورهای در حال توسعه با چالش‌هایی نظیر ضعف سیستم حقوق کیفری مرتبط، کمبود منابع و نابرابری‌های اجتماعی مواجه‌اند که مانع تحقق کامل حق تغذیه می‌شود.</div> <div style="text-align: justify;">Background and Objective: Food security is one of the criteria and necessities of human development. The right to access sufficient and safe food is a central pillar of development, societal health, and the foundation for future generations. In this regard, criminal law can provide a set of tools to guarantee this right. This research comparatively examines the effects of criminal law on guaranteeing the right to nutrition in developed and developing countries. The main objective is to compare the common criminal law policies, legislation, and mechanisms in these two categories of countries to promote food rights and monitoring institutions in the realm of food security and the prevention of malnutrition. Method: This research was written using various legal sources, employing an analytical-comparative method and relying on library resources. Ethical Considerations: In this research, while respecting the originality of the texts, honesty and integrity have been observed. Findings: In this research, the findings indicate major differences in the relevant criminal law structures, the extent and type of policymaking, and international cooperation at the national level.
