fa مسئولیت مدنی ناشی از نقض حق بر تغذیه سالم و امنیت غذایی در حقوق ایران Civil Liability Arising from the Violation of the Right to Healthy Nutrition and Food Security in Iranian Law مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امنیت غذایی و دسترسی به تغذیه سالم و ایمن، از مهم‌ترین مؤلفه‌های تحقق حق بر سلامت و از حقوق بنیادین بشری محسوب می‌شود. این حق، علاوه بر ارتباط مستقیم با کرامت انسانی، نقش تعیین‌کننده‌ای در توسعه پایدار و عدالت اجتماعی ایفا می‌کند. با توجه به چالش‌های نوظهور جهانی از جمله رشد جمعیت، تغییرات اقلیمی، بحران‌های اقتصادی و تهدیدات زنجیره تأمین مواد غذایی، تضمین دسترسی پایدار به غذای سالم به یکی از دغدغه‌های اساسی دولت‌ها و نهادهای بین‌المللی تبدیل شده است. در این میان، نظام‌های حقوقی با بهره‌گیری از سازوکارهایی نظیر مسئولیت مدنی، می‌توانند نقش مهمی در پیشگیری از نقض این حق و جبران خسارات ناشی از آن ایفا کنند. هدف اصلی این پژوهش، بررسی مبانی و ارکان مسئولیت مدنی ناشی از نقض حق بر تغذیه سالم و امنیت غذایی در حقوق ایران و تحلیل ظرفیت‌های حقوقی موجود در حمایت از مصرف‌کنندگان و تضمین سلامت عمومی است. روش: روش پژوهش به صورت کیفی و روش جمع‌آوری اطلاعات کتابخانه‌ای انتخاب شده است و تجزیه و تحلیل داده‌ها به صورت توصیفی ـ تحلیلی می‌باشد. ملاحظات اخلاقی: در پژوهش حاضر جنبه‌های اخلاقی مطالعه کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش نشان داد در حقوق ایران، امکان استناد به مسئولیت مدنی برای جبران خسارات ناشی از نقض حق بر تغذیه سالم و امنیت غذایی وجود دارد و این مسئولیت می‌تواند متوجه تولیدکنندگان، توزیع‌کنندگان و حتی نهادهای نظارتی شود. همچنین مشخص شد ارکان تقصیر، ضرر و رابطه سببیت نقش محوری در تحقق این مسئولیت دارند، هرچند در برخی موارد خاص امکان اعمال مسئولیت بدون تقصیر نیز قابل تصور است. از سوی دیگر، نتایج بیانگر وجود خلأهای تقنینی و ضعف در نظارت اجرایی است که می‌تواند مانع حمایت کامل از حقوق مصرف‌کنندگان شود. نتیجه‌گیری: مسئولیت مدنی به عنوان یکی از مهم‌ترین ابزارهای حقوقی، نقش مؤثری در حمایت از حق بر تغذیه سالم و تأمین امنیت غذایی در حقوق ایران ایفا می‌کند. با این حال، برای تحقق حمایت مؤثر از مصرف‌کنندگان، تقویت نظارت اجرایی، رفع خلأهای قانونی و توسعه رویکردهای حمایتی به ‌ویژه در حوزه مسئولیت بدون تقصیر ضروری به نظر می‌رسد.</div> <div style="text-align: justify;">Background and Aim: Food security and access to healthy and safe nutrition are among the most important foundations for realizing the right to health and are considered fundamental human rights. In addition to its direct connection with human dignity, this right plays a decisive role in sustainable development and social justice. Considering global challenges such as climate change, population growth, economic crises and disruptions in food supply chains, ensuring sustainable access to healthy food has become one of the main concerns of governments and international organizations. In this context, legal systems, through mechanisms such as civil liability, can play an important role in preventing violations of this right and compensating damages resulting from it. The main objective of this study is to examine the foundations and elements of civil liability arising from violations of the right to healthy nutrition and food security in Iranian law and to analyze existing legal capacities for consumer protection and safeguarding public health. Methods: This research was conducted using a qualitative approach and data were collected through library-based methods. The collected data were analyzed using a descriptive-analytical method. Ethical Considerations: In the present study, ethical principles related to library-based research, including originality of sources, honesty and integrity in citation and reporting, were observed. Results: The findings indicate that within Iranian law, it is possible to invoke civil liability to compensate damages resulting from violations of the right to healthy nutrition and food security. This liability may be attributed to producers, distributors and even supervisory bodies. The results also show that fault, damage and causation play key roles in establishing liability, although in certain specific cases, strict liability may also be applicable. Additionally, the findings reveal the existence of legislative gaps and weaknesses in regulatory supervision that may hinder full protection of consumer rights. Conclusion: Civil liability serves as one of the most important legal tools for supporting the right to healthy nutrition and ensuring food security in Iranian law.
