fa امنیت غذایی در پرتو سیاستگذاری عمومی و جنایی با تأکید بر توسعه پایدار Food Security and Public and Criminal Policy in virtue of Sustainable Development مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امنیت غذایی وضعیتی است که در آن، آحاد جامعه بشری برای داشتن زندگی پویا و سالم، همیشه به مقدار غذای کافی، سالم و مغذی تأمین‌کننده نیازها و اولویت‌های تغذیه‌ای، دسترسی فیزیکی، اقتصادی، اجتماعی و فرهنگی داشته باشند. این هنجار بین‌المللی و ملی، از حقوق بنیادین بشری نسل‌های اول تا سوم، از جمله حق بر امنیت، حق بر غذا، حق بر غذای کافی، حق بنیادین رهایی از گرسنگی، حق رفاه و تأمین اجتماعی، حق زندگی با استانداردهای مناسب و حق بر توسعه نشأت گرفته است. امنیت غذایی در جامعه بین‌المللی ابتدا یکی از اهداف فرعی توسعه هزاره و در سند توسعه پایدار مصوب مجمع عمومی سازمان ملل متحد (سپتامبر 2015 م.) به عنوان یکی از اهداف اصلی و مستقل توسعه پایدار پذیرفته شد. هنجاری که در هنگام شکل‌گیری ماهیت اجتماعی ـ اقتصادی داشته و به تدریج به ارزشی اجتماعی، اقتصادی، فنی و حقوقی بدل شده است. چالش‌های جهانی، منطقه‌ای و ملی در حوزه فقر، سوءتغذیه و گرسنگی موجب شد، امنیت غذایی به اولویت‌ سیاستگذاری و برنامه‌ریزی‌های کلان ملی و بین‌المللی بدل شود. بر اساس تعریف اسناد بین‌المللی به شرح پژوهش، حق بر توسعه متضمن توسعه در زمینه‌های سیاسی، فرهنگی، اقتصادی و اجتماعی و رفاه همزمان با توزیع عادلانه منابع و منافع ناشی از توسعه در میان مردم است. اینکه مردم صاحبان حق نسل سوم و دولت‌ها صاحب تکلیف ملازم با آن هستند و در مواردی مانند حق بر توسعه، دولت‌ها بدون اینکه رأساً صاحبان حق نسل سوم باشند، برای احقاق حق در سطح بین‌المللی به نمایندگی از ملت خود اقدام می‌کنند؛ با اینکه دولت‌های در حال توسعه رأساً صاحب این حق معرفی شوند، اختلاف نظر است. این پژوهش با هدف ترسیم چندراهی دانش میان مسائل سیاستگذاری عمومی و جنایی راجع به امنیت غذایی در بستر حق بر توسعه به عنوان پدیدآورنده نقش جدید و هماهنگ‌کننده فراملی برای تحقق امنیت غذایی پایدار، درصدد پاسخ به این سؤالات است: آیا توسعه پایدار، امنیت غذایی را به عنوان یکی از اهداف تحقق خود برشمرده است؟ سیاستگذاری‌هایی پیرامون امنیت غذایی در سند توسعه پایدار کدام است؟ روش: این پژوهش با رویکرد کیفی و روش تحلیلی ـ توصیفی از طریق گردآوری، مطالعه و تحلیل منابع کتابخانه‌ای، اسناد بین‌المللی و اینترنتی انجام و نگارش شده است. ملاحظات اخلاقی: صداقت، امانتداری در گزارش متون، استناددهی به منابع و پرهیز از سوگیری انجام شده است. یافته‌ها: حق بر توسعه به عنوان حقوق بشر نسل سوم، مبنای امنیت غذایی قرار گرفته است. امنیت غذایی نیز یکی از شاخص‌ها و اهداف توسعه پایدار است. به بیان دیگر، امنیت غذایی در بستر توسعه پایدار محقق می‌شود و خود، عامل ایجاد توسعه پایدار است. هدف دوم از مجموعه اهداف هفده‌گانه توسعه پایدار به صراحت تضمین امنیت غذایی، تغذیه و کشاورزی پایدار را از اهداف و برنامه‌های تحقق توسعه پایدار تا سال 2030 برشمرده است. همچنین در اجلاس ملل متحد برای توسعه پایدار بر موضوع امنیت غذایی تأکید شد. یافته‌های پژوهش حاکی از شناسایی هنجار امنیت غذایی توسط سیاستگذار ایرانی در چهارچوب اسناد بین‌المللی همراه با واکاوی جلوه‌های سیاستگذاری‌های عمومی متنوع در ابعاد توسعه‌ای، اقتصادی، اجتماعی، سیاسی، فرهنگی و فنی امنیت غذایی در اسناد بین‌المللی است. از سوی دیگر، بخشی از رفتارهای فاصله‌گیر از هنجار امنیت غذایی به عنوان پدیده جنایی، همگام با ارزش امنیت غذایی، رشد کرده و به تدریج، اشکال پیچیده‌تری یافته است. انحراف‌ها و انواع بزه‌های صنفی، انضباطی، مدنی و کیفری بی‌شماری که امنیت غذایی و ارکان اصلی (موجودبودن، دسترسی، قابلیت استفاده و پایداری) و مؤلفه‌‌های فرعی آن را تهدید می‌کند، جلوه‌های پدیده جنایی ناقض امنیت غذایی و موضوع بررسی دانش سیاست جنایی است. نتیجه‌گیری: امنیت غذایی در آینده‌ جامعه بین‌المللی، همچنان با سیاستگذاری و هدف‌گذاری همه‌جانبه در ابعاد مختلف امنیت غذایی آمیخته است. گویی تحقق امنیت غذایی پایدار جز با توسعه پایدار و به تعبیر بومی رشد و پیشرفت متوازن در ابعاد فنی، علمی، اقتصادی و زیست‌محیطی با شرایط با ثبات و مسئولانه حاکمیتی میسر نخواهد بود. امری که می‌تواند به رغم اختلاف در هدف‌گذاری‌های داخلی با هدف‌گذاری‌های بین‌المللی به عنوان بستر توجه، تأمین و ارتقای امنیت غذایی (با تمرکز و تأکید بر اختلاف در موضوع هدف‌گذاری توسعه و پیشرفت)، همچنان آموزه‌ای برای سیاستگذاری‌های ملی باشد.</div> <div style="text-align: justify;">Background and Aim: Food security is a condition in which all members of the human community, at all times, have physical, economic, social and cultural access to sufficient, safe and nutritious food that meets their dietary needs and food preferences for an active and healthy life. This international and national norm is derived from fundamental human rights of the first to the third generation, including the right to security, the right to food, the right to adequate food, the fundamental right to be free from hunger, the right to social security and welfare, the right to an adequate standard of living and the right to development. Within the international community, food security was initially considered a subsidiary target of the Millennium Development Goals and was subsequently recognized as an independent and primary goal of the Sustainable Development Goals in the UN General Assembly resolution (September 2015). This norm, which initially possessed a predominantly socio-economic character upon its formation, has gradually evolved into a social, economic, technical and legal value. Numerous global, regional and national challenges in the realms of poverty, malnutrition and hunger have elevated food security to a priority in national and international macro-level policymaking and planning. According to the definition contained in international instruments, the right to development entails advancement in all political, cultural, economic and social spheres, coupled with the equitable distribution of resources and benefits derived from development among all people. There is doctrinal disagreement regarding whether the people are the holders of third-generation rights and states bear the concomitant duties and in instances such as the right to development, whether states-without themselves being the direct holders of third-generation rights-act on the international level as representatives of their nations to realize these rights, or whether developing states themselves are considered the direct holders of this right. Numerous global, regional and national challenges in the areas of poverty, malnutrition and hunger have made food security a priority for national and international macro-policy and planning. This research aims to map the interdisciplinary knowledge between public and criminal policy issues concerning food security within the framework of the right to development as a creator of a new and transnational coordinating role for achieving sustainable food security. It seeks to answer the following questions: Has sustainable development listed food security as one of its objectives? What policies regarding food security have been formulated in the Sustainable Development document? Methods: This research has been conducted and written using a qualitative approach and an analytical-descriptive method through the collection, study and analysis of library resources, international documents and online materials. Ethical Considerations: In all stages of writing the present research, the ethical aspects of library-based study including the originality of the texts, honesty and trustworthiness have been observed. Results: The right to development, as a third-generation human right, forms the basis of food security. Food security is also one of the indicators and goals of sustainable development. In other words, food security is realized within the context of sustainable development and is itself a factor in creating sustainable development. The second goal of the seventeen Sustainable Development Goals explicitly lists ensuring food security, improved nutrition and sustainable agriculture as objectives and programs for achieving sustainable development by 2030. Furthermore, the UN Conference on Sustainable Development, emphasized the issue of food security. The findings indicate the recognition of the food security norm by Iranian policymakers within the framework of international instruments, along with an analysis of the manifestations of diverse public policies in the developmental, economic, social, political, cultural and technical dimensions of food security in international documents. On the other hand, certain behaviors deviating from the food security norm have emerged and evolved as criminal phenomena, in parallel with the value of food security and have gradually taken on more complex forms. Countless deviations of professional, disciplinary, civil and criminal offenses, that threaten food security and its core pillars (availability, access, utilization and stability) and subsidiary components are clear manifestations of the criminal phenomenon threatening food security and are the subject of study for the science of criminal policy. Conclusion: In the future envisioned by the international community, food security remains intertwined with comprehensive policymaking and targeting across various dimensions of food security. It appears that achieving sustainable food security will only be possible through sustainable development, or in local terms, balanced growth and progress in technical, scientific, economic and environmental dimensions, under stable and responsible governance conditions.
