fa تحول مفهوم حقوق سلامت: از مبانی تاریخی تا تبارشناسی فلسفی و چالش‌های معاصر The Evolution of the Concept of Health Rights: From Historical Foundations to Philosophical Genealogy and Contemporary Challenges مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: مفهوم حقوق سلامت، امروزه به عنوان یکی از بنیادی‌ترین ارکان حقوق بشر و سیاستگذاری اجتماعی، در بستر تحولات تاریخی، فلسفی و فناورانه دستخوش تحولاتی اساسی شده است. در پایان، بر لزوم هم‌افزایی میان سیاستگذاری حقوقی و اخلاق پزشکی و اهمیت نگاه آینده‌نگر و مشارکت‌محور جهت تحقق عادلانه حق سلامت تأکید می‌شود. روش: این پژوهش با رویکرد توصیفی ـ تحلیلی انجام شده است. ملاحظات اخلاقی: تمام ملاحظات اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها: این مقاله، ضمن تبیین ریشه‌های تاریخی و فرهنگی این حق از تمدن‌های باستان تا جهان معاصر، به بررسی مبانی فلسفی آن در قالب دوگانه حق سلبی و ایجابی، و نیز تحلیل تطبیقی میان سه سنت لیبرالیسم، سوسیالیسم و جهان‌بینی‌های دینی می‌پردازد، بدین‌ترتیب مرزهای دخالت دولت و فرد، جایگاه عدالت توزیعی و مسأله کرامت انسانی در پیوندی میان نظریه و عمل به بحث گذاشته می‌شود. همچنین مقاله با پرداختن به چالش‌های نوظهور همچون جهانی‌شدن سلامت، ورود فناوری‌های نوین (سلامت دیجیتال، هوش مصنوعی) و نقش عدالت بین‌نسلی و محیط زیست، گستره مفهومی حقوق سلامت را توسعه می‌دهد. نمونه‌هایی از سیاستگذاری‌های ملی و بین‌المللی، مسائل گروه‌های آسیب‌پذیر و بیان تجربه‌های عملی (از جمله همه‌گیری کووید-۱۹ و نمونه‌های پرونده‌های قضایی) جایگاه حقوق سلامت را در عرصه اجرا و چالش‌های پیش رو نشان می‌دهد. نتیجه‌گیری: در این مقاله، بر لزوم هم‌افزایی میان سیاستگذاری حقوقی و اخلاق پزشکی و اهمیت نگاه آینده‌نگر و مشارکت‌محور جهت تحقق عادلانه حق سلامت تأکید می‌شود.</div> <div style="text-align: justify;">Background and Aim: The concept of the right to health, as a fundamental pillar of human rights and social policy, has undergone profound transformations in the context of historical, philosophical and technological developments. Methods: This research adopts a descriptive-analytical approach. Ethical Considerations: All ethical consideration was observed. Results: This article traces the historical and cultural roots of the right to health from ancient civilizations to the contemporary world and analyzes its philosophical foundations through the dichotomy of negative and positive rights, as well as a comparative analysis of liberal, socialist and religious traditions. Accordingly, it discusses the boundaries of state and individual intervention, distributive justice and human dignity at the intersection of theory and practice. The study further explores contemporary challenges such as globalization of health, the emergence of novel technologies (digital health, artificial intelligence), intergenerational justice and environmental issues, thereby expanding the conceptual scope of health law. National and international policy examples, issues faced by vulnerable groups and real-life experiences - such as the COVID-19 pandemic and judicial case studies - highlight the implementation and challenges of the right to health. The article underscores the necessity of synergy between legal policy and medical ethics and emphasizes a future-oriented, participatory approach to the equitable realization of the right to health.
