fa تحلیل حقوقی جایگاه محصولات تراریخته در حقوق سلامت و امنیت غذایی ایران Legal Analysis of the Position of Genetically Modified Products in Iranian Health and Food Security Laws مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: محصولات تراریخته به عنوان یکی از نوآورانه‌ترین و در عین حال مناقشه‌برانگیزترین دستاوردهای علم زیست‌فناوری در قرن بیست و یکم مطرح شده‌اند. هدف اصلی از توسعه این محصولات، افزایش مقاومت گیاهان در برابر آفات و خشکسالی، بهبود ارزش غذایی، و در نهایت، افزایش بازدهی کشاورزی برای پاسخگویی به تقاضای فزاینده جهانی برای غذا بوده است. با این وجود، ورود این محصولات به زنجیره غذایی بشر، نگرانی‌های جدی و بنیادینی را در دو حوزه کلیدی حقوقی سلامت عمومی و امنیت مواد غذایی ایجاد کرده است. این چکیده به بررسی حقوقی جایگاه این محصولات در چهارچوب نظام‌های حقوقی مرتبط، با تمرکز بر اصول اساسی و چالش‌های پیش رو می‌پردازد. روش: این پژوهش به شیوه‌ توصیفی ـ تحلیلی و با تکیه بر منابع کتابخانه‌ای انجام شده است. در مرحله نخست، مبانی نظری و اسناد بین‌المللی مرتبط با ایمنی زیستی، سلامت عمومی و امنیت غذایی مورد بررسی قرار گرفت، سپس مقررات ملی و بین‌المللی ناظر بر تولید، عرضه و برچسب‌گذاری محصولات تراریخته تحلیل و مقایسه شد تا جایگاه حقوقی این محصولات در دو حوزه حقوق سلامت و حقوق امنیت مواد غذایی تبیین گردد. ملاحظات اخلاقی: در انجام این پژوهش، تمامی اصول اخلاقی پژوهش‌های علمی، از جمله امانتداری، استناد دقیق به منابع، پرهیز از تحریف داده‌ها و رعایت بی‌طرفی در تحلیل دیدگاه‌ها رعایت شده است. یافته‌ها: نتایج بررسی‌ها نشان می‌دهد که چهارچوب‌های قانونی در خصوص محصولات تراریخته در بسیاری از کشورها هنوز ناکافی و پراکنده است. از منظر حقوق سلامت، مهم‌ترین خلأها مربوط به نبود نظام یکپارچه ارزیابی خطر، ضعف در شفافیت اطلاعاتی و کمبود ضمانت اجرای مؤثر برای برچسب‌گذاری است. نتیجه‌گیری: پژوهش حاضر نشان می‌دهد که توازن میان پیشرفت فناوری تراریخته و امنیت غذایی منوط به اجرای مقررات جامع و چندسطحی است که با همکاری‌های بین‌المللی در تدوین استانداردهای ارزیابی خطر و برچسب‌گذاری تقویت می‌شود. تضمین اعتماد عمومی و حق انتخاب آگاهانه تنها از طریق حکمرانی حقوقی هوشمندانه و مشارکت علمی ـ اجتماعی به طور ایمن و پایدار امکان‌پذیر است.</div> <div style="text-align: justify;">Background and Aim: Transgenic crops have emerged as one of the most innovative and controversial achievements of biotechnology in the 21st century. The main goal of developing these crops has been to increase plant resistance to pests and drought, improve nutritional value, and ultimately, increase agricultural productivity to meet the growing global demand for food. However, their introduction into the human food chain has raised serious and fundamental concerns in two key legal areas: public health and food safety. This abstract reviews the legal status of these crops within the relevant legal systems, focusing on the fundamental principles and challenges ahead. Methods: This research was conducted in a descriptive-analytical manner and based on library resources. In the first stage, theoretical foundations and international documents related to biosafety, public health and food security were examined. Then, national and international regulations governing the production, supply and labeling of genetically modified products were analyzed and compared to explain the legal status of these products in the two areas of health law and food safety law. Ethical Considerations: In conducting this research, all ethical principles of scientific research were observed, including confidentiality, accurate citation of sources, avoidance of data distortion, and impartiality in analyzing viewpoints. Results: The results of the survey show that the legal frameworks regarding genetically modified products in many countries are still inadequate and fragmented. From a health rights perspective, the most important gaps relate to the lack of an integrated risk assessment system, weak information transparency, and the lack of effective enforcement guarantees for labeling. Conclusion: The present study shows that the balance between the advancement of GM technology and food security depends on the implementation of comprehensive and multi-level regulations, strengthened by international cooperation in the development of risk assessment and labeling standards.
