fa مبانی حقوقی مداخله دولت در تنظیم بازار مواد غذایی در شرایط بحران Legal Basis of Government Intervention in Regulating the Food Market in Crisis Situations مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امنیت غذایی از حقوق بنیادین بشر و یکی از مؤلفه‌های اصلی توسعه پایدار محسوب می‌شود. در نظام حقوقی ایران، علیرغم تأکید قانون اساسی بر تأمین نیازهای اساسی شهروندان، سازوکارهای حقوقی مشخص و یکپارچه‌ای برای مداخله دولت در تنظیم بازار مواد غذایی، به ویژه در شرایط بحرانی مانند تحریم، خشکسالی یا همه‌گیری بیماری‌ها وجود ندارد. هدف این پژوهش، بررسی مبانی حقوقی مداخله دولت در بازار مواد غذایی در شرایط بحران و تحلیل نقاط قوت و ضعف این مداخلات در چهارچوب قوانین موجود است. روش: این مطالعه به شیوه توصیفی ـ تحلیلی و با بهره‌گیری از منابع کتابخانه‌ای انجام شده است. اسناد حقوقی داخلی، از جمله قانون اساسی، قوانین عادی، مقررات موضوعه و مصوبات نهادهای اجرایی، مورد بررسی قرار گرفته و از روش تحلیل محتوا برای ارزیابی نقش حقوقی دولت در تنظیم بازار غذا استفاده شده است. ملاحظات اخلاقی: در پژوهش حاضر جنبه‌های اخلاقی مطالعه کتابخانه‌ای شامل اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: نتایج بررسی نشان می‌دهد که قوانین موجود، هرچند در برخی موارد به دولت اختیار مداخله در بازار غذا را داده‌اند، اما فاقد انسجام، پیش‌بینی‌پذیری و چهارچوب حقوقی روشن هستند. در عمل، نهادهایی مانند وزارت جهاد کشاورزی، وزارت صمت و ستاد تنظیم بازار، ابزارهایی همچون قیمت‌گذاری، واردات اضطراری و توزیع سهمیه‌ای را به کار می‌برند، اما این اقدامات به دلیل فقدان پشتوانه حقوقی منسجم و سیاستگذاری بلندمدت، با چالش‌هایی چون نارضایتی تولیدکنندگان، تبعیض در توزیع و فساد اداری مواجه‌اند. نتیجه‌گیری: برای تقویت نقش دولت در تأمین امنیت غذایی به ویژه در شرایط بحران، لازم است چهارچوب حقوقی روشنی با تأکید بر عدالت غذایی، پایداری عرضه و رعایت حقوق مصرف‌کنندگان و تولیدکنندگان تدوین گردد. پیشنهاد می‌شود تدوین یک قانون جامع با محوریت «حق بر غذا» و پیش‌بینی سازوکارهای قانونی برای مداخلات دولتی در شرایط ویژه، در دستور کار سیاستگذاران و قانونگذاران قرار گیرد.</div> <div style="text-align: justify;">Background and Aim: Food security is a fundamental human right and one of the main components of sustainable development. In the Iranian legal system, despite the emphasis of the Constitution on meeting the basic needs of citizens, there are no specific and integrated legal mechanisms for government intervention in regulating the food market, especially in crisis situations such as sanctions, drought, or epidemics. The purpose of this study is to examine the legal foundations of government intervention in the food market in crisis situations and analyze the strengths and weaknesses of these interventions within the framework of existing laws. Methods: This study was conducted in a descriptive-analytical manner using library resources. Domestic legal documents, including the Constitution, ordinary laws, statutory regulations and approvals of executive bodies, were examined and the content analysis method was used to assess the legal role of the government in regulating the food market. Ethical Considerations: In the present study, the ethical aspects of library research, including the originality of texts, honesty and trustworthiness, have been observed. Results: The results of the study show that the existing laws, although they have given the government the authority to intervene in the food market in some cases, lack coherence, predictability and a clear legal framework. In practice, institutions such as the Ministry of Agricultural Jihad, the Ministry of Semat and the Market Regulation Headquarters use tools such as pricing, emergency imports and quota distribution, but due to the lack of coherent legal support and long-term policymaking, these measures face challenges such as producer dissatisfaction, discrimination in distribution and administrative corruption. Conclusion: To strengthen the role of the government in ensuring food security, especially in crisis situations, it is necessary to develop a clear legal framework with an emphasis on food justice, supply sustainability and respect for the rights of consumers and producers.
