fa مسئولیت مدنی دولت در قبال نوزادان و کودکان دچار نقص مادرزادی و ژنتیکی Civil Responsibility of the State towards Newborns and Children with Congenital and Genetic Defects مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در این مقاله، به بررسی مسئولیت‌های مدنی دولت در قبال نوزادان و کودکان دچار نقص مادرزادی و ژنتیکی پرداخته می‌شود. هدف اصلی این پژوهش تحلیل تأثیر سیاستگذاری‌های دولت در زمینه افزایش جمعیت و جوانی جمعیت بر افزایش تولد این کودکان و بررسی پیامدهای آن بر خانواده‌ها و اقتصاد کشور است. وجود این مشکلات نه‌تنها تبعات شخصی برای فرد معلول دارد، بلکه آثار عمیق اجتماعی و اقتصادی را نیز به همراه می‌آورد. روش: این پژوهش به شیوه توصیفی ـ تحلیلی صورت گرفته و با تحلیل مفاد ماده ۵۳ قانون جوانی جمعیت و دستورالعمل‌های مربوط به آن تکمیل شده است. این روش به تحلیل داده‌های قانونی و اجتماعی، بررسی مسئولیت‌های دولت و ارائه شواهدی مبنی بر اثرات طولانی‌مدت هزینه‌های توان‌بخشی و پیامدهای ناشی از تولد کودکان معلول می‌پردازد. ملاحظات اخلاقی: در این پژوهش، ملاحظات اخلاقی شامل رعایت حقوق خانواده‌ها و کودکان دچار نقص مادرزادی و ژنتیکی و توجه به حساسیت‌های اجتماعی و فرهنگی مرتبط با این موضوعات می‌باشد. همچنین تأکید بر حفظ حریم خصوصی خانواده‌ها و تهیه اطلاعات به صورت ناشناس و با توافق مستند در فرآیند تحقیق از جمله ملاحظات اخلاقی مهم است. یافته‌ها: یافته‌های این تحقیق نشان می‌دهد که دولت و نمایندگان مصوب‌کننده طرح‌ها در قبال تولد هر کودک معلول که به واسطه محدودیت‌های غربالگری به دنیا آمده‌اند، مسئولیت دارند. در این راستا، از منظر قانونی و فقهی، هر فردی که موجب زیان به دیگری شود، موظف به جبران آن است. این یافته‌ها بر ضرورت سیاستگذاری‌های دقیق و جامع در زمینه پیشگیری و حمایت از خانواده‌ها تأکید دارند. نتیجه‌گیری: نتیجه‌گیری این مقاله نشان‌دهنده لزوم تعیین مسئولیت‌های مدنی دولت در قبال نوزادان دچار نقص مادرزادی و ژنتیکی است. دولت باید با ارائه خدمات، حمایت مالی و برنامه‌های توان‌بخشی مناسب، به خانواده‌ها کمک کند. علاوه بر این، سیاست‌های افزایش جمعیت باید به گونه‌ای طراحی شوند که از دوقطبی‌های اجتماعی جلوگیری کرده و به ترتیب بر حقوق و رفاه کودکان و خانواده‌ها تأثیر مثبت داشته باشند.</div> <div style="text-align: justify;">Background and Aim: This article examines the civil responsibilities of the government toward infants and children with congenital and genetic defects. The main objective of this study is to analyze the impact of government policies on population growth and rejuvenation on the increasing number of births of such children, as well as to investigate the consequences for families and the national economy. These challenges not only create personal difficulties for the disabled individual but also bring profound social and economic impacts. Methods: This research has been conducted using a descriptive-analytical method and has been completed through the analysis of Article 53 of the Youthful Population Law and its related directives. This method involves analyzing legal and social data, examining the responsibilities of the government and providing evidence regarding the long-term effects of rehabilitation costs and the consequences arising from the birth of disabled children. Ethical Considerations: The ethical considerations of this research include respecting the rights of families and children with congenital and genetic defects and taking into account the social and cultural sensitivities associated with these issues. Furthermore, emphasis is placed on preserving the privacy of families and collecting information anonymously and with documented consent during the research process, which are among the key ethical principles. Results: The findings of this study indicate that the government and the legislators who approved the plans are responsible for the birth of any disabled child born as a result of screening restrictions. In this regard, from both legal and jurisprudential perspectives, any person who causes harm to another is obliged to compensate for it. These findings emphasize the necessity of precise and comprehensive policymaking in the fields of prevention and family support. Conclusion: The conclusion of this article highlights the need to establish the civil responsibilities of the government toward infants with congenital and genetic defects. The government should support families through the provision of services, financial assistance and appropriate rehabilitation programs.
