fa مراقبت غذایی به عنوان حقی اضطراری در اسناد بین‌المللی با نگاهی به حقوق ایران Nutritional Care as an Emergency Right in International Documents with a Galance on Iranian Law مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: هدف این مقاله، تبیین مراقبت غذایی به عنوان حقی اضطراری در اسناد بین‌المللی با نگاهی به حقوق ایران می‌باشد. روش: حق بر غذا به عنوان حق بنیادین در اعلامیه جهانی حقوق بشر و اسناد بین‌المللی متعددی به رسمیت شناخته شد، اگرچه برای چند دهه، تغذیه کم و بیش مترادف غذا بود، در نیم قرن گذشته، به عنوان مفهوم گسترده‌تری ـ که نتیجه چند عامل از جمله غذا، بهداشت و... می‌باشد ـ مورد شناسایی واقع گردید. در این میان حق مراقبت غذایی ـ که به تغذیه شخص بیمار بستری در مراکز درمانی مربوط می‌شود ـ دارای اهمیت بیشتری است. ملاحظات اخلاقی: اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها: حق داشتن غذای کافی برای اولین‌بار به عنوان حق بنیادین بشر در ماده 25 اعلامیه جهانی حقوق بشر در 1948 به رسمیت شناخته شده و در ﺑﻨﺪ1 ﻣﺎده 11 ﻣﻴﺜﺎق ﺑﻴﻦاﻟﻤﻠﻠﻲ ﺣﻘﻮق اﻗﺘﺼﺎدی، اﺟﺘﻤﺎﻋﻲ و ﻓﺮهنگی مصوب 1976 ﺑﺎ ﻋﻨﻮان اﺳﺘﺎﻧﺪارد «زﻧﺪگی ﻣﻨﺎﺳﺐ» همین معنی مورد توجه واقع شده است. با اینکه تغذیه تنها سه بار در کنوانسیون حقوق کودک ذکر شده است، از طریق تأکید بر غذا، بهداشت و مراقبت، روشن می‌سازد که تغذیه مناسب باید به عنوان حق بنیادین بشری در نظر گرفته شود. در قانون اساسی جمهوری اسلامی ایران علاوه بر اینکه به طور کلی به کشاورزی به عنوان منبع تغذیه توجه شده است، در بند 12 اصل سوم برطرف‌نمودن هر نوع محرومیت، از جمله در زمینه «تغذیه» جزء وظایف دولت به شمار آمده و در بند 1 اصل چهل و سوم به «خوراک» اشاره شده است. نتیجه‌گیری: از آنجا که حق مراقبت غذایی، ارتباط تنگاتنگی با حق بر غذا و حق سلامت و سایر حقوق بشری دارد و نقض آن، اغلب ممکن است بهره‌مندی از سایر حقوق بشری مانند بهداشت و... را مختل سازد، باید فراتر از حق بشری به عنوان حقی اضطرری محسوب گردد.</div> <div style="text-align: justify;">Background and Aim: The aim of this article is to explain the nutritional care as an emergency right in international documents with a view to Iranian law. Methods: The right to food was recognized as a human fundamental right in Universal Declaration of Human Rights and numerous international instruments. Although for several decades, nutrition was more or less synonymous with food, in the last half century, it has been recognized as a broader concept - the result of several factors, including food, health, etc. Among them, the right to nutritional care - which concerns the nutrition of a sick person hospitalized in medical centers - is of greater importance. Ethical Considerations: Ethical principles have been observed in writing of this article. Results: The right to adequate food was first recognized as a fundamental human right in Article 25 of Universal Declaration of Human Rights in 1948 and the same meaning was considered in Article 11, paragraph 1, of International Covenant on Economic, Social and Cultural Rights, adopted in 1976, as a standard of "adequate living". Although nutrition is mentioned only three times in the Convention on the Rights of the Child, through it's emphasis on food, health and care, it makes clear that adequate nutrition should be considered a fundamental human right. In addition to generally recognizing agriculture as a source of nutrition, the Constitution of Islamic Republic of Iran, in paragraph 12 of Article 3, eliminating any kind of deprivation, including in the field of "nutrition", is considered one of the duties of government and in paragraph 1 of Article 43, "food" is mentioned.
