Background and Aim: Accurate diagnosis plays a crucial role in patients' lives and health, increasing their chances of recovery. The diagnosis stage is one of the most fundamental phases of medical care. Diagnostic errors in the medical field refer to mistakes made during the process of identifying, interpreting, or making medical decisions, which may lead to incorrect diagnosis or treatment. These errors have significant medical, legal and economic consequences. The aim of this research is to examine such errors in the diagnosis and treatment stage
Methods: This is a theoretical study, with a descriptive-analytical research method. The data collection tools include sources, evidence, databases such as Google Scholar, PubMed, Web of Science and analysis of opinions from the medical commissions of Yazd province, as well as scientific research and perspectives from leading figures in this field and guides for understanding the nature of the Issue.
Ethical Considerations: Throughout the writing of this research, authenticity of texts, honesty and integrity have been observed.
Results: The findings of the research indicate that factors contributing to diagnostic errors include failure to obtain a complete medical history, ineffective communication with the patient, errors related to diagnostic tests, certain personality traits of the physician such as arrogance, failure to consult with other specialists and the physician's insufficient experience. Additionally, the patient plays a role in these errors by failing to provide accurate medical history, delaying medical visits, not describing symptoms clearly and not actively cooperating in undergoing tests.
Conclusion: Investigations show that, from the perspective of the Medical System Organization of Yazd Province, any diagnostic error that leads to the loss of a golden opportunity for treatment accelerates the progression of the disease, or results in the patient's death is considered a medical error. However, if the error does not impact the patient's recovery process, it is considered an obstacle to criminal liability.
