The Right to Mental Health in Family Law

Background and Aim: It is no secret that children grow up and learn the first communication with the community in the family. The performance of parents in the family will have a direct impact on the mental and physical health of children. Factors affecting mental health in people's lives include understanding one's own behavior, creating healthy and useful relationships, social and personal skills, and controlling emotions. Therefore, paying attention to the right of mental health in the family is very important.
Methods: In the current fundamental research, descriptive-analytical and library-based, the laws and regulations existing in Iran's legal system in the field of mental health in the family have been examined.
Ethical Considerations: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been observed.
Results: By examining the laws and regulations governing the family, examples of legal attention to the rights of mental health in the family have been found, in which the legislator has addressed matters beyond the material and tangible rights of the family. These cases are sovereign divorce, khula divorce, dissolution of marriage, good company and respect for the privacy of couples.
Conclusion: Considering the importance of mental health in individual and family life, it is appropriate that with special attention to this field, society members and especially couples have gained enough knowledge about each other's mental health rights so that in order to promote mental health rights first in family and then take steps in society.
