fa حق بر سلامت روان کودکان در مخاصمات نوین و بازاندیشی مسئولیت بین‌المللی دولت‌ها در پرتو کرامت انسانی و اخلاق زیستی Children’s Right to Mental Health in Contemporary Armed Conflicts: Rethinking State International Responsibility in Light of Human Dignity and Bioethics مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: تحولات ساختاری در مخاصمات معاصر موجب شده است که بخش مهمی از آسیب‌های وارده بر کودکان از حوزه صدمات جسمانی فراتر رفته و به قلمرو آسیب‌های روانی، شناختی و هویتی گسترش یابد. با وجود این، نظام حقوق بین‌الملل همچنان عمدتاً بر حمایت از تمامیت جسمانی متمرکز است و ابعاد روانی حق بر سلامت کودکان از چارچوب هنجاری منسجم و روشنی برخوردار نیست. هدف این پژوهش، تبیین جایگاه سلامت روان کودکان به عنوان یکی از ابعاد بنیادین حق بر سلامت و بازاندیشی مسئولیت بین‌المللی دولت‌ها در قبال آسیب‌های روانی ناشی از مخاصمات نوین در پرتو کرامت انسانی و اخلاق زیستی است. روش: پژوهش حاضر با رویکردی توصیفی ـ تحلیلی و با استفاده از منابع کتابخانه‌ای، اسناد بین‌المللی، رویه‌ها و تفاسیر نهادهای حقوق بشری و ادبیات مرتبط با حقوق بین‌الملل بشر، حقوق بین‌الملل بشردوستانه و اخلاق زیستی انجام شده است. ملاحظات اخلاقی: در تدوین این مقاله جنبه‌های اخلاقی شامل حفظ اصالت متون، صداقت، رضایت و اطلاع‌رسانی رعایت شده است. یافته‌ها: یافته‌های پژوهش نشان می‌دهد که اشکال نوین مخاصمات، از جمله جنگ‌های ترکیبی، عملیات شناختی، آوارگی اجباری، فروپاشی محیط‌های حمایتی و عادی‌سازی خشونت، آثار عمیق و ماندگاری بر سلامت روان کودکان برجای می‌گذارند. همچنین بررسی مبانی حقوقی و هنجاری موجود نشان می‌دهد که اصول کرامت انسانی، منافع عالیه کودک، عدم اضرار، حمایت از اشخاص آسیب‌پذیر و مسئولیت نسبت به نسل‌های آینده، ظرفیت لازم برای شناسایی و حمایت از حق بر سلامت روان کودکان و توسعه تعهدات دولت‌ها در این حوزه را فراهم می‌کنند. نتیجه‌گیری: سلامت روان کودکان را باید یکی از مؤلفه‌های بنیادین حق بر سلامت و بخشی جدایی‌ناپذیر از کرامت انسانی دانست. بر این اساس، مسئولیت بین‌المللی دولت‌ها در مخاصمات معاصر نمی‌تواند به پیشگیری از آسیب‌های جسمانی محدود شود، بلکه شامل تعهدات پیشگیرانه، حمایتی، درمانی و ترمیمی در قبال آسیب‌های روانی کودکان نیز خواهد بود. از این منظر، حق بر سلامت روان کودکان در حال ظهور به عنوان یکی از حقوق بنیادین نوین در حقوق بین‌الملل معاصر است که شناسایی و تضمین آن مستلزم توسعه هنجارهای موجود و بازتعریف مسئولیت دولت‌ها در شرایط مخاصمه است.</div> <div style="text-align: justify;">Background and Aim: Structural transformations in contemporary armed conflicts have extended the harm inflicted upon children beyond physical injuries to include profound psychological, cognitive, and identity-related damage. Despite this reality, international law remains largely focused on the protection of physical integrity, while the mental dimension of children’s right to health lacks a coherent normative framework. This study aims to examine children’s mental health as a fundamental component of the right to health and to reconceptualize the international responsibility of States for conflict-related psychological harm in light of human dignity and bioethics. Methods: This research employs a descriptive-analytical approach based on library research and an examination of international legal instruments, human rights bodies’ jurisprudence and interpretative documents, as well as scholarly literature in international human rights law, international humanitarian law, and bioethics. Ethical Considerations: In all stages of writing the present research, the ethical aspects of library-based study Including the originality of the texts, honesty and trustworthiness have been observed. Results: The findings demonstrate that contemporary forms of conflict, including hybrid warfare, cognitive operations, forced displacement, the collapse of protective environments, and the normalization of violence, generate severe and long-term consequences for children’s mental health. The study further reveals that the principles of human dignity, the best interests of the child, non-maleficence, protection of vulnerable persons, and responsibility toward future generations provide a normative basis for recognizing and strengthening the protection of children’s right to mental health and for expanding States’ obligations in this field. Conclusion: Children’s mental health should be recognized as a fundamental component of the right to health and an integral element of human dignity. Accordingly, the international responsibility of States in contemporary armed conflicts cannot be confined to the prevention of physical harm but must also encompass preventive, protective, therapeutic, and reparative obligations regarding psychological injuries suffered by children.
