fa واکاوی تعهدات دولت‌ها نسبت به حق بر امنیت آب کودکان در شرایط مخاصمات مسلحانه Analytical Study of States’ Obligations Regarding Children’s Right to Water Security in Armed Conflict Situations مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در دهه‌های اخیر، مسأله امنیت آب به یکی از مؤلفه‌های بنیادین امنیت انسانی و زیست‌پایداری تبدیل شده است. در بستر مخاصمات مسلحانه بین‌المللی، به ویژه در مناطق بحران‌زده‌ای چون خاورمیانه، تخریب منابع آبی و استفاده ابزاری از آب به عنوان سلاح جنگی، تهدیدی مستقیم علیه حق بر بقا، سلامت و کرامت انسانی کودکان به شمار می‌رود. هدف این پژوهش، تحلیل حقوقی و بین‌المللی «نقض حق بر امنیت آب کودکان» در مخاصمات مسلحانه و بررسی تعهدات دولت‌ها بر اساس اسناد الزام‌آور حقوق بشردوستانه و حقوق بشر است. روش: این پژوهش با رویکرد توصیفی ـ تحلیلی و روش اسنادی انجام شده است. داده‌ها از طریق بررسی تطبیقی معاهدات بین‌المللی، اسناد الزام‌آور (از جمله کنوانسیون حقوق کودک، پروتکل‌های الحاقی ژنو و اساسنامه رم دیوان کیفری بین‌المللی) و گزارش‌های رسمی نهادهای سازمان ملل گردآوری و تحلیل شده‌اند. ملاحظات اخلاقی: در تدوین این مقاله جنبه‌های اخلاقی شامل حفظ اصالت متون، صداقت، رضایت و اطلاع‌رسانی رعایت شده است. یافته‌ها: نتایج پژوهش نشان می‌دهد که «سلاح‌سازی آب» در جریان مخاصمات، نقض آشکار اصول بنیادین حقوق بشردوستانه، از جمله اصول تفکیک، تناسب و رفتار انسانی است و به طور خاص منجر به تضییع حقوق بنیادین کودکان، از جمله حق بر بقا، حق بر سلامت و حق بر توسعه پایدار می‌شود. همچنین خلأهای تقنینی و اجرایی در تضمین امنیت آب کودکان در اسناد بین‌المللی مشاهده می‌شود که نیازمند بازنگری تفسیری و نهادینه‌سازی حق بر آب به عنوان یکی از ابعاد حق بر حیات است. نتیجه‌گیری: پژوهش حاضر تأکید می‌کند که صلح پایدار بدون امنیت آب ممکن نیست و تحقق امنیت آب کودکان نیازمند ترکیب هم‌زمان سه محور است: ۱ـ تقویت تعهدات دولت‌ها نسبت به توسعه پایدار و حفاظت از منابع آبی پیش از مخاصمات؛ 2ـ الزام دولت‌ها به رعایت اصول حقوق بشردوستانه در طول درگیری‌ها؛ 3ـ بازسازی ساختارهای آبی و بهداشتی پس از مخاصمات با مشارکت جامعه بین‌المللی. به‌ همین منظور، پیشنهاد می‌شود «پروتکل ویژه امنیت آب کودکان» به اسناد موجود حقوق بشردوستانه افزوده شود تا چهارچوبی الزام‌آور برای پیشگیری از سلاح‌سازی آب و تضمین دسترسی ایمن کودکان به آب سالم فراهم گردد.</div> <div style="text-align: justify;">Background and Aim: In recent decades, water security has emerged as a cornerstone of human security and sustainable development. Within the context of international armed conflicts, particularly in conflict zones such as the Middle East, the deliberate destruction of water infrastructure and the weaponization of water constitute direct threats to the rights of children to life, health and dignity. This study aims to analyze the international legal framework governing the right to water security for children during armed conflicts and to evaluate state obligations under international humanitarian and human rights law. Methods: The study adopts a descriptive-analytical approach based on documentary research. It employs comparative legal analysis of key international treaties (including the Convention on the Rights of the Child (CRC), the Geneva Conventions and their Additional Protocols and the Rome Statute of the International Criminal Court) supplemented by reports from UNICEF, the UN Human Rights Council and UNEP. Ethical Considerations: In all stages of writing the present research, the ethical aspects of library-based study Including the originality of the texts, honesty and trustworthiness have been observed. Results: Findings reveal that the weaponization of water during armed conflicts constitutes a blatant violation of fundamental principles of international humanitarian law, namely, distinction, proportionality and humane treatment and gravely infringes upon children’s essential rights to survival, health and sustainable development. Moreover, normative and institutional gaps remain in protecting children’s water security, highlighting the need to reconceptualize the right to water as an integral component of the right to life. Conclusion: The study concludes that sustainable peace is unattainable without water security. Ensuring children’s access to safe and sufficient water requires a threefold strategy: 1. Reinforcing state obligations toward sustainable water management before conflicts; 2. Strict adherence to humanitarian principles during hostilities; 3. Comprehensive post-conflict reconstruction of water and sanitation systems through international cooperation.
