fa ماهیت حقوقی سایبورگ و امکان‌سنجی برخورداری آن از شخصیت حقوقی متمایز The Legal Essence of a Cyborg and the Feasibility of Its Having a Distinct Legal Personality مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: روند درهم‌تنیدگی بدن‌مندانه انسان و فناوری به واسطه به کارگیری ایمپلنت‌ها، پروتزها و تراشه‌ها و تبدیل‌شدن به انسان سایبورگی در حال افزایش است. این روند فزاینده زمینه‌ساز گذار انسان به عصر پساانسانگرایی است. تفاوت‌های عملکردی انسان سایبورگی و انسان عادی، ضرورت تدوین مقررات ویژه از حیث حقوق و مسئولیت‌های ناشی از سایبورگی‌شدن را بیش از پیش نمایان می‌سازد. پیش‌شرط نخستین طراحی قانونمند حقوق و مسئولیت‌های سایبورگ‌ها، شناسایی برخورداری آن‌ها از شخصیت حقوقی متمایز است. در این پژوهش به دنبال شناسایی ماهیت حقوقی سایبورگ و امکان‌سنجی برخورداری آن‌ها از شخصیت حقوقی خواهیم بود. روش: پژوهش پیشرو از نوع مروری و به شیوه توصیفی ـ تحلیلی است. منابع و داده‌های مورد نیاز به شیوه کتابخانه‌ای و با مراجعه به تارنماها و بانک‌های اطلاعاتی بین‌المللی نظیر Academia، Researchgate، PhilPapers، Springer، SSRN و عمدتاً از محل کتاب‌ها و مقالات سال‌های 25-2014 گردآوری شده است. ملاحظات اخلاقی: این پژوهش با رعایت کامل تمامی ملاحظات اخلاقی در خصوص رعایت امانتداری، صداقت اصالت متون انجام گرفته است. یافته‌ها: درهم‌تنیدگی مصنوعات فناورانه (نظیر ایمپلنت‌ها، پروتزها و تراشه‌ها) در اعضای بدن انسان، زمینه‌ساز پدیداری موجودیتی نوین به نام سایبورگ گردیده است که به جهت تفاوت قابل ملاحظه‌ای که به لحاظ بدنی یا ذهنی با انسان عادی دارد، با فراتررفتن از مرزها و دوگانه‌گرایی‌های تثبیت‌شده و سنتی پیشین، شخصیت حقوقی متفاوت و متمایزی نسبت به انسان عادی پیدا می‌کند. این شخصیت حقوقی در عصر پساانسان‌گرایی و گسترش فضای مجازی به جهت پویایی پیوسته و دگرگونی بی‌وقفه خود برخلاف شخصیت حقوقی انسان عادی ثابت و ایستا نیست، بلکه سیال و پویا است. نتیجه‌گیری: در عصر پساانسانگرایی، فناوری‌های نوین، هوش مصنوعی، روند سایبورگی‌شدن انسان، منتهی به شناسایی و تمایز سایبورگ از انسان‌های عادی می‌شود، به نحوی که نظام‌های حقوقی می‌بایست شخصیت حقوقی متمایزی برای انواع سایبورگ‌های بدنی و ذهنی قائل شوند. شخصیت حقوقی سایبورگ (اعم از سایبورگ بدن و سایبورگ ذهن)، با ساختار سنتی، ایستا و یکپارچه شخصیت حقوقی انسان عادی همخوانی و سازگاری ندارد. و بر همین اساس پاسخگوی شخصیت پویا و سیال سایبورگ که فراتر از مرزبندی‌ها و دوگانه‌گرایی‌های تثیبت یافته سنتی (نظیر دوگانگی ذهن/ بدن، دوگانگی انسان/ اشیا) قرار دارد، نمی‌باشد. این هستنده‌های پویا علاوه بر فضای حقیقی در محیط آنلاین، دیجیتال و مجازی متنوع و متکثر عصر جدید نیز قرار دارند. بر همین اساس به موازات اینکه هویت‌های بدنی، فرهنگی و اجتماعی اشخاص به سمت تکثرگرایی، چندپارگی و دگرگون‌پذیری پیوسته پیش می‌روند، شخصیت حقوقی سایبورگ نیز می‌بایست خود را با این ساختار نوین هماهنگ سازد و به سمت هویت و شخصیت حقوقی پویا و شناور در فضای حقیقی و مجازی پیش رود.</div> <div style="text-align: justify;">Background and Aim: The process of physical integration of humans and technology is increasing through the use of implants, prostheses, and chips, and the transformation into cyborgs. This increasing process is paving the way for humans to transition to the posthuman era. The functional differences between cyborgs and ordinary humans make it more and more evident that special regulations should be developed regarding the rights and responsibilities arising from cyborgization. The prerequisite for the first legal design of the rights and responsibilities of cyborgs is the recognition of their distinct legal personality. In this research, we will seek to identify the legal nature of cyborgs and assess the feasibility of their having legal personality. Methods: The research is a review and descriptive-analytical method. The required sources and data were collected through library methods and by referring to international websites and databases such as Academia, Researchgate, PhilPapers, Springer, SSRN, and mainly from books and articles from 2009-25. Ethical Considerations: This research was conducted in full compliance with all ethical considerations regarding confidentiality, honesty, and originality of the texts. Results: The integration of technological artifacts (such as implants, prostheses, and chips) into human body parts has paved the way for the emergence of a new entity called cyborg Due to their significant physical or mental differences from normal humans, they acquire a different and distinct legal personality from normal humans by going beyond the previously established and traditional boundaries and dualisms. In the era of posthumanism and the expansion of cyberspace, the legal personality of cyborgs is not fixed and static, unlike the legal personality of normal humans, but rather fluid and dynamic, due to its continuous dynamism and constant transformation. Conclusion: In the era of posthumanism, new technologies, artificial intelligence, and the process of human cyborgization, cyborgs are identified and distinguished from ordinary humans. In such a way that legal systems must recognize a distinct legal personality for all types of physical and mental cyborgs. The legal personality of a cyborg (both physical and mental cyborgs) is not compatible with the traditional, static, and unified structure of the legal personality of a normal human. Accordingly, it does not respond to the dynamic and fluid personality of a cyborg that is beyond the boundaries and traditional established dualisms (such as the mind/body duality, the human/object duality). These dynamic beings In addition to the real space, they are also in the diverse and pluralistic online, digital, and virtual environments of the new era.
