fa مصادیق و آثار مسئولیت مدنی ناشی از ارائه دارو در داروخانه؛ مطالعه تطبیقی در حقوق ایران و آمریکا Instances and Consequences of Civil Liability Arising from the Dispensing of Medication in a Pharmacy; A Comparative Study in the Laws of Iran and the United States of America مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: با گسترش دانش پزشکی و تنوع داروها، ارائه دارو به یکی از چالش‌برانگیزترین حوزه‌های حقوقی تبدیل شده است. مسئولیت مدنی ناشی از ارائه دارو به بررسی مواردی می‌پردازد که در آن‌ها نقص یا اشتباه در ارائه دارو منجر به آسیب به افراد می‌شود. اهمیت این موضوع از آنجاست که باید میان حمایت از حقوق بیماران و تضمین امنیت حقوقی تولیدکنندگان تعادل برقرار شود. روش: این نوشتار با روش تحلیلی ـ توصیفی و بهره‌گیری از منابع کتابخانه‌ای انجام شده است. ملاحظات اخلاقی: در تمام مراحل نگارش ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: نقص‌ها و اشتباهات در ارائه دارو، از جمله تجویز نادرست، عدم توجه به سوابق پزشکی، و تحویل داروی معیوب، می‌تواند به مسئولیت داروسازان منجر شود. همچنین عدم ارائه اطلاعات کافی درباره دارو و عوارض آن، سلامت مصرف‌کنندگان را به خطر می‌اندازد. مقایسه قوانین ایران و ایالات متحده نشان می‌دهد که در ایران، مسئولیت داروخانه بسته به نقششان (تولیدکننده یا توزیع‌کننده) متفاوت است و سازمان FDO به دلیل فقدان قوانین شفاف، به ‌سختی مورد مؤاخذه قرار می‌گیرد. در مقابل، در آمریکا با وجود مصونیت FDA، تولیدکنندگان و توزیع‌کنندگان با شدت بیشتری مسئول شناخته می‌شوند. نتیجه‌گیری: سلامت عمومی وابسته به رعایت دقیق دستورالعمل‌های حرفه‌ای در تجویز، تحویل و اطلاع‌رسانی درباره داروهاست. در ایران و آمریکا، مسئولیت اصلی بیشتر متوجه تولیدکنندگان و توزیع‌کنندگان است تا نهادهای نظارتی. تدوین قوانین شفاف‌تر و ایجاد رویه قضایی منسجم می‌تواند پاسخگویی و ایمنی در عرضه دارو را تقویت کند. </div> <div style="text-align: justify;">Background and Aim: With the advancement of medical knowledge and the proliferation of pharmaceuticals, the dispensing of medication has emerged as one of the most challenging areas of law. Civil liability in this context addresses cases where a defect or error in the dispensing of medication results in harm to individuals. The significance of this issue lies in the need to strike a balance between protecting patients' rights and ensuring legal certainty for manufacturers. Methods: This study was conducted using a descriptive-analytical method and library-based sources.. Ethical Considerations: Throughout the writing process, authenticity, honesty, and integrity have been upheld. Results: Errors and shortcomings in medication dispensing - such as incorrect prescribing, failure to consider medical history, and the delivery of defective medication - can give rise to pharmacist liability. Furthermore, failing to provide adequate information regarding a drug and its side effects endangers consumer health. A comparison of Iranian and U.S. laws reveals that in Iran, pharmacy liability varies based on the entity's role (manufacturer or distributor), and the Food and Drug Organization (FDO) is rarely held accountable due to a lack of clear regulations. In contrast, despite the FDA's immunity, manufacturers and distributors in the United States face stricter liability. Conclusion: Public health depends on the strict observance of professional guidelines regarding the prescribing, dispensing, and communication of information about medications. In both Iran and the United States, primary responsibility rests more with manufacturers and distributors than with regulatory bodies.
