fa نقش و جایگاه ادله الکترونیکی در دادرسی‌های نظام سلامت الکترونیک The Role and Place of Electronic Evidence in Electronic Health System Proceedings مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حق بر سلامت به عنوان یک حق هماهنگی دولت را بر آن داشته تا در راستای خدمت‌رسانی، نظام سلامت الکترونیک را ایجاد کند. این نظام با بهره‌گیری از اینترنت و شماره ملی اشخاص در پی تسهیل خدمات پزشکی و پیشگیری از جرائمی همچون جعل، جرائم پزشکی درمانی بوده است، لذا هدف از مقاله حاضر بررسی نقش و جایگاه ادله الکترونیکی در دادرسی‌های نظام سلامت الکترونیک می‌&lrm;باشد. روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش حاکی از این است که مصادیق ادله الکترونیک داده‌های محتوایی و شکلی است که در شناسایی اصول نظام سلامت الکترونیک به رهگذر حق سلامت و صیانت از حقوق شهروندی، حفظ محرمانگی و امنیت اطلاعات و عدالت‌محوری می‌رسیم. همچنین کارکردهای ادله الکترونیک در دادرسی‌های نظام سلامت الکترونیک شامل قابلیت ارائه مؤلف، تاریخ و زمان ثبت، اصالت و ذخیره و قابلیت دسترسی می‌باشند. نتیجه‌گیری: مشکلاتی همچون عدم آشنایی و آموزش کافی، مدیریت ناکافی و نبود امضای الکترونیک، استانداردهای دسترسی و ذخیره‌سازی، مشکلات زیرساختی اینترنت مشکلاتی را ایجاد نموده است. از سوی دیگر با توجه به تعریف ادله الکترونیک، نظام سلامت الکترونیک نیز با داشتن اوصافی داده‌پیام، بهره‌گیری از فضای دیجیتالی و ذخیره‌سازی دارای آثار و اعتبار ادله الکترونیک هستند.</div> <div style="text-align: justify;">Background and Aim: The right to health as a right has led the government to establish an electronic health system in order to provide services. This system, by using the internet and the national number of individuals, has aimed to facilitate medical services and to prevent crimes such as forgery and medical treatment crimes. Therefore, the purpose of this article is to examine the role and position of electronic evidence in the proceedings of the electronic health system. Methods: This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based, referring to documents, books and articles. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: The findings of the research indicate that the examples of electronic evidence are the data of content and form, which in identifying the principles of the electronic health system, we arrive at the path of the right to health and protection of citizen rights, maintaining confidentiality and security of information and central justice; Also, the functions of electronic evidence in electronic health system proceedings include the ability to present the author, date and time of registration, authenticity, storage and accessibility. Conclusion: Problems such as lack of familiarity and sufficient training, insufficient management and lack of electronic signature, access and storage standards, internet infrastructure issues have created problems.
