fa نحوه جبران خسارت در تولد فرزند ناخواسته در پی نقص بستن لوله رحم از سوی طبیب Methods to Compensate for the Birth of an Unwanted Child Due to the Doctor's Failure to Close the Fallopian Tube مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: غالباً تصویری که از تولد در اذهان متبادر می‌شود، تصویری مثبت و عامیانه است، اما تصویر منطبق با واقعیت و جامعه می‌تواند متفاوت باشد، بنابراین پژوهش حاضر با هدف بررسی و شناسایی تأثیرات مخرب روانی بارداری ناخواسته بر روی والدین، تأثیر فرزندان ناخواسته بر اجتماع، هزینه و بودجه‌ای که جامعه در قبال تولدهای اشتباهی که منجر به معلولیت است، می‌پردازد. همچنین نقش و مسئولیت مدنی در پی تقصیر پزشکان در روند بارداری و یا عقیم‌سازی ارادی مورد بحث است. روش: روش تحقیق، تحلیلی ـ توصیفی است. روش گردآوری اطلاعات کتابخانه‌ای و جستجو در پایگاه‌های اطلاعاتی مرتبط (Google Scholar, SID, SocINEX, Medline, Econlit, Pub Med) و از طریق منابع دیگر انجام ‌شده است. ابزار گردآوری اطلاعات فیشبرداری است. جستجوها بر موضوعات مرتبط و مناقشات اخلاقی و حقوقی در زمینه حاملگی نادرست و زندگی اشتباه متمرکز بوده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: «حاملگی نادرست» و «زندگی اشتباهی» با معضلات اخلاقی گیج‌کننده‌ای همراه است و سؤالات حقوقی ظریفی را ایجاد می‌کند. این مسائل در کشورهای مختلف و در مناسبت‌های خاص با راه ‌حل‌های متفاوتی مواجه شده و بحث‌های اخلاقی و حقوقی را برانگیخته است. تقصیر پزشک در پی عملیات عقیم‌سازی و یا اطلاعات یا تشخیص نادرست آنان منجر به بارداری شده و یا شانس خاتمه بارداری را از مادر سلب کرده است. یکی از حیاتی‌ترین مسائل ایجاد تعادل بین حق تعیین سرنوشت و خودمختاری مادر است، این مرحله دوران پیچیده‌ای است، چراکه هم حقوق زوجین را دربر می‌گیرد و هم با حقوق جنین درهم‌تنیده است. نتیجه‌گیری: دادگاه‌های سراسر جهان عموماً به دلیل پیامدهای اخلاقی و قانونی، مانند وجود به عنوان آسیب، حق تولد و ماهیت آسیب متحمل شده، تمایلی به تأیید ادعاهای زندگی نادرست ندارند. برخی از کشورها مانند فرانسه با قانونی که در مارس 2002 تصویب شد، اقدام به زندگی اشتباه را به طور قطعی حذف کردند. فقط در هلند و در سه ایالت از ایالات‌متحده آمریکا (کالیفرنیا، واشنگتن و نیوجرسی) اقدامات Wrongful Life مجاز است. در کشورهای دیگر، مانند بلژیک قانون نامشخص است.</div> <div style="text-align: justify;">Background and Aim: Often, the image of birth is a positive and popular one, but the image corresponding to reality and society can be different. Therefore, this study aimed to investigate and identify the psychological effects of unwanted pregnancy on parents, the impact of unwanted children on society, the cost and budget that society pays for wrong births that lead to disability, as well as the role and civic responsibility following the fault Doctors discuss the process of pregnancy or voluntary sterilization. Methods: The research method is a descriptive analytical study. The method of collecting library data and searching in databases (Google Scholar, SID, SocINEX, Medline, Econlit, Pub Med) and other sources have been performed. Data collection tool is stubs. Searches have focused on related topics and ethical and legal conflicts in the context of incorrect pregnancy and the wrong life. Ethical Considerations: In all stages of the present research, while keeping the originality of the texts, honesty and integrity have been observed. Results: "Wrongful Pregnancy" and "<a name="_Hlk152187393">Wrong</a>ful Life" are associated with confusing ethical dilemmas and create delicate legal questions. These issues have faced different solutions in different countries and on special occasions and have sparked ethical and legal debates. The doctor's fault is due to the sterilization or misinformation or diagnosis that led to the pregnancy or denied the mother the chance to terminate the pregnancy. One of the most critical issues is balancing the right to self-determination and maternal autonomy, which is a complex phase because it encompasses both the rights of couples and is intertwined with the rights of the fetus. Conclusion: Courts around the world are generally reluctant to endorse false life claims because of ethical and legal consequences, such as existence as harm, birthright and nature of harm. Some countries, such as France, definitively eliminated the wrong-life action with a law passed in March 2002. Only in the Netherlands and in three states of the United States (California, Washington and New Jersey) are Wrongful Life actions permitted.
