fa سیاست کیفری ایران در قبال کارآزمایی‌های بالینی در پرتو اسناد بین‌المللی Iran's Criminal Policy Regarding Clinical Trials in the Light of International Documents مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: کارآزمایی بالینی یکی از مهم‌ترین و شایع‌ترین پژوهش‌های مداخله‌ای یا تجربی بوده که در راستای بهبود وضعیت درمانی بیماران و یا به جهت پیشرفت علم پزشکی انجام می‌شود. به سبب اهمیت موضوع و جلوگیری از ورود آسیب و عوارض مهلک نسبت به آزمودنی‌های انسانی و حمایت از حق بر سلامت بیماران، نیاز است که قانونگذار ایران، بستر مداخلات کیفری و رسیدگی افتراقی به جرائم ارتکابی در این نوع از تحقیقات پزشکی را فراهم آورده و در راستای حمایت از حقوق بیماران و تحقیقات پزشکی، به قصور احتمالی محقق نیز رسیدگی شود. در این مقاله، با بررسی قوانین و مقررات ملی و فراملی در خصوص کارآزمایی‌های بالینی، سعی بر آن داریم تا ضمن بیان چالش‌های تقنینی موجود، سیاست کیفری متناسب با الگو‌های استاندارد جهانی ارائه شود. روش: این پژوهش از نوع نظری بوده و روش آن به صورت توصیفی ـ تحلیلی می‌باشد و شیوه جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات علمی صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل پژوهش، ضمن رعایت اصول ‌امانتداری و بی‌طرفی، اصالت متون و صداقت نیز رعایت شده است. یافته‌ها: با توجه به مخاطرات احتمالی علیه آزمودنی‌های انسانی و همچنین رعایت حقوق بیماران، لازم است که قانونگذار نگاه ویژه‌ای به کارآزمایی‌های بالینی داشته و جهت جلوگیری از ورود هرگونه آسیب و خطری، صرفاً به عمومات مسئولیت کیفری بسنده نکرده و قوانین و مقررات کیفری مختص به این نوع از تحقیقات پزشکی را وضع نماید. نتیجه‌گیری: مسلماً انجام کارآزمایی‌های بالینی یا به‌ طور کلی انجام هرگونه تحقیقات زیست‌پزشکی برای دستیابی به مداخلات درمانی، امری اجتناب‌‌ناپذیر بوده، لکن این مهم چیزی از ضرورت توجه به سلامت بیماران نمی‌کاهد. همچنین در کارآزمایی‌های بالینی که با هدف پیشرفت علم‌ پزشکی انجام می‌شود، قوانین موضوعه باید به نحوی باشد که به متقاضیان شرکت در کارآزمایی، صرفاً به عنوان یک آزمودنی نگریسته نشود. به همین جهت ضروری است که قانونگذار، جهت اتخاذ سیاست کیفری کارآمد، در راستای استاندارد‌های حرفه‌ای که در گستره بین‌المللی توسط سازمان جهانی بهداشت یا شورای بین‌المللی سازمان‌های علوم پزشکی تدوین شده است، همسو شده و تدابیر تقنینی، قضایی و اجرایی پویا و متناسب با اقتضائات روز در راستای حمایت کیفری از حقوق بیماران را تصویب نماید.</div> <div style="text-align: justify;">Background and Aim: Clinical trial is one of the most important and most common interventional or experimental researches that is done in order to improve the treatment status of patients or to advance medical science. Due to the importance of the issue and prevention of harm and fatal complications to human subjects and protection of patients' right to health, there is a need for the Iranian legislature to provide a platform for criminal interventions and differential treatment of crimes committed in this type of medical research and in line with Protecting the rights of patients and medical research, the possible negligence of the researcher should also be addressed. In this article, by examining the national and international laws and regulations regarding clinical trials, we are trying to present a penal policy in accordance with the global standard models while expressing the existing legislative challenges. Methods: This research is of a theoretical type and its method is descriptive-analytical and the method of collecting information is library-based and referring to documents, books and scientific articles. Ethical Considerations: In all stages of the research, in addition to observing the principles of trustworthiness and impartiality, the authenticity of the texts and honesty have also been observed. Results: Considering the possible risks against human subjects as well as respecting the rights of patients, it is necessary that the legislator has a special look at clinical trials and in order to prevent any harm and danger, he is not satisfied with the generality of criminal liability and criminal laws and regulations specific to Establish this type of medical research. Conclusion: Of course, conducting clinical trials or any biomedical research in general to achieve therapeutic interventions is inevitable, but this does not diminish the need to pay attention to the health of patients. Also, in clinical trials that are conducted with the aim of advancing medical science, the rules should be such that the applicants to participate in the trial are not viewed as just subjects.
