fa کاربردها و اثرگذاری متاورس در حوزه سلامت و چالش‌ها و مسائل حقوقی نوظهور Applications and Effectiveness of Metaverse in the Field of Health and Challenges and Emerging Legal Issues مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: دوران همه‌گیری کرونا بیش از پیش، محدودیت و نارسایی‌های نظام‌های سلامت و مراقبت‌های بهداشتی موجود را نشان داد. بنابراین نوآوری در مراقبت‌های بهداشتی و مدل‌های کسب ‌و کار جدید با استفاده از محیط‌های مجازی رایانه‌ای برای ارائه یک سیستم مراقبت بهداشتی جایگزین، به رویکردی اجتناب‌ناپذیر بدل شده است. امروزه، تحول دیجیتال تنها به ارتباطات مجازی محدود نمی‌شود، بلکه شامل دیجیتالی‌کردن شبکه ارتباطات اجتماعی در صنعت مراقبت‌های بهداشتی با استفاده از فناوری متاورس نیز می‌شود. متاورس یک دنیای مجازی فراگیر است که توسط واقعیت مجازی و واقعیت افزوده تسهیل می‌شود. این مقاله درصدد این است که آخرین تحولات در حوزه سلامت و صنعت مراقبت‌های بهداشتی را مورد بررسی قرار دهد. متاورس و مؤلفه‌های آن کارکردهای نوین گسترده‌ای را در قلمروی پزشکی از راه دور، مراقبت‌های بالینی، آموزش، سلامت روان، سلامت جسمانی، دام‌پزشکی و داروسازی ارائه می‌کند. برنامه‌های کاربردی متاورس می‌تواند به ایجاد راه‌ حلی خودپاینده، پایدار و مطمئن برای سیستم‌های بهداشتی پزشکی راهگشا باشد. سلامت در متاورس در عین حال که افق‌های جدیدی را فراروی بشر قرار می‌دهد، با چالش‌های حقوقی بسیاری میز مواجه خواهد شد. در این نوشتار با روش توصیفی ـ تحلیلی مسائل و چالش‌های نوظهور حقوقی مهمی در زمینه امنیت داده‌ها و حریم خصوصی، مالکیت معنوی، امور مالی و قراردادها، هک هویت مورد بررسی قرار می‌دهد. همان‌گونه که بشر در ابتدای ظهور اینترنت با مشکلات حقوقی مواجه بود و راهکارهایی در ادامه ارائه خواهد شد، اینک با پدیداری متاورس نیز می‌توان امیدوار بود که دسترسی به راه حل‌هایی برای رفع این‌گونه چالش‌ها مقدور است. روش: روش تحقیق به صورت توصیفی ـ تحلیلی و کتابخانه‌ای بوده است. ملاحظات اخلاقی: در تمام مراحل پژوهش، اصل صداقت و امانتداری علمی رعایت شده است. یافته‌ها: این نوشتار مسائل و چالش‌های نوظهور حقوقی مهمی در زمینه امنیت داده‌ها و حریم خصوصی، مالکیت معنوی، امور مالی و قراردادها و هتک هویت را مورد بررسی قرار می‌دهد. نتیجه‌گیری: همان‌گونه که بشر در ابتدای ظهور اینترنت با مشکلات حقوقی مواجه بود و راهکارهایی در ادامه ارائه خواهد شد، اینک با پدیداری متاورس نیز می‌توان امیدوار بود که دسترسی به راه حل‌هایی برای رفع این‌گونه چالش‌ها مقدور است.</div> <div style="text-align: justify;">Background and Aim: The corona epidemic showed more than ever the limitations and inadequacies of the existing health and healthcare systems. Therefore, innovation in health care and new business models using computer virtual environments to provide an alternative health care system has become an inevitable approach. Today, digital transformation is not only limited to virtual communication, but also includes the digitization of the social communication network in the healthcare industry using metaverse technology. Metaverse is an immersive virtual world facilitated by virtual reality and augmented reality. This article aims to review the latest developments in the field of health and the healthcare industry. Metaverse and its components provide a wide range of innovative functions in the realms of telemedicine, clinical care, education, mental health, physical health, veterinary medicine, and pharmaceuticals. Metaverse applications can lead to the creation of a self-sustaining, stable and reliable solution for medical health systems. Health in the metaverse, at the same time as it opens new horizons for mankind; it will face many legal challenges. In this article, with a descriptive and analytical method, important emerging legal issues and challenges in the field of data security and privacy, intellectual property, financial affairs and contracts are examined, identity hacking. Just as humanity was faced with legal problems at the beginning of the emergence of the Internet and solutions were presented later, now with the emergence of Metaverse, we can hope that access to solutions to solve such challenges is possible. Methods: The research method was descriptive-analytical and library. Ethical Considerations: In all stages of the research, honesty and scientific trustworthiness has been observed. Results: In this article, important emerging legal issues and challenges in the field of data security and privacy, intellectual property, financial affairs and contracts is examined, identitie hacking.
