fa همکاری بین‌المللی در مبارزه با تروریسم بیولوژیک به مثابه جنایت علیه بشریت International Cooperation in Combating Biological Terrorism as a Crime against Humanity مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: تروریسم بیولوژیک انتشار عوامل بیولوژیکی برای ایجاد بیماری یا مرگ در افراد، حیوانات یا محیط زیست به شکل عامدانه با هدف وحشت‌آفرینی و وادارساختن دولت یا سازمان بین‌المللی به انجام عملی بر اساس نگرشی سیاسی، ملی یا مذهبی تعریف شده است. آسیب‌پذیری بالقوه در برابر بیوتروریسم بسیار جدی است، در ایالات متحده در سال 2001 چهار نامه ارسالی حاوی باکتری سیاه زخم، منجر به بیماری 22 نفر، مرگ 5 نفر و 23 میلیون دلار هزینه برای پاکسازی اماکنی گردید که در معرض آلودگی قرار گرفته بودند، لذا با توجه به نتایج مرگبار این حملات باید مبارزه کیفری همه‌جانبه با آن در بعد داخلی و بین‌المللی مورد توجه باشد، اما چالش‌های جدی نیز در جنایت علیه بشریت دانستن آن، وجود دارد. روش: این مقاله به روش توصیفی ـ تحلیلی با جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات انجام گرفته است. ملاحظات اخلاقی: دﺭ ﭘﮋﻭﻫﺶ ﺣﺎﺿﺮ ﺟﻨﺒﻪﻫﺎﻱ ﺍﺧﻼﻗﻲ ﻣﻄﺎﻟﻌﻪ ﻛﺘﺎﺑﺨﺎﻧﻪﺍﻱ ﺷﺎﻣﻞ ﺍﺻﺎﻟﺖ ﻣﺘﻮﻥ، ﺻﺪﺍﻗﺖ ﻭ ﺍﻣﺎﻧﺘﺪﺍﺭﻱ ﺭﻋﺎﻳﺖ ﺷﺪﻩ ﺍﺳﺖ. یافته‌ها: چنانچه حملات تروریستی بیولوژیکی واجد تعریف ماده 7 اساسنامه دیوان کیفری بین‌المللی در قالب در یک حمله «گسترده» یا «سازمان‌یافته» بر ضد یک «جمعیت غیر نظامی» و با «علم به آن حمله» ارتکاب یابند، می‌تواند جنایت علیه بشریت به شمار آید و مطابق قطعنامه 1540 شورای امنیت (2004 م.)، چارچوبی برای کشورها ایجاد می‌شود تا از توسعه، دستیابی، ساخت، یا انتقال سلاح‌های هسته‌ای، شیمیایی یا بیولوژیکی توسط بازیگران غیر دولتی نیز جلوگیری کنند، اما مبارزه با تروریسم بیولوژیک از جهات فنی و تخصصی نیاز به واکنش همزمان ملی و بین‌المللی دارد. این حملات به علت ایجاد تلفات زیاد، ایجاد عوارض طولانی‌مدت، انتشار سریع، عدم وجود سیستم&rlm;های شناسایی کارآمد، گسترش احساس ناامنی، وجود دوره نهفته، هزینه‌های ارزان و دسترسی آسان، توسط گروه‌های تروریستی با اقبال فزاینده‌ای مواجه است. به همین جهت جرم‌انگاری این حملات هم در قوانین داخلی و هم در تعهدات بین‌المللی اهمیت دارد و واکنش حقوقی صرف نیز در مبارزه کافی نیست، بلکه ابعاد همکاری بین‌المللی شامل اقدامات فنی، پزشکی و امنیتی نیز شود. نتیجه‌گیری: بیوتروریسم یک تهدید جدی از سوی گروه‌های تروریستی است و نقطه تلاقی حقوق بین‌الملل و حقوق بشر (حق حیات حق، حق بر سلامت و بر محیط زیست سالم) در حوزه تهدید علیه امنیت ملی، بین‌المللی، نقض حقوق بشر و صلح به شمار می‌آید، لذا در بعد کیفری مسأله جرم‌انگاری، صلاحیت محاکم، معاضدت بین‌المللی و در بعد حقوق مخاصمات مسلحانه، تلفات شدید غیر نظامیان، حمایت از قربانیان، امکان رسیدن حملات تروریستی به آستانه حمله مسلحانه، عمل به مثابه سلاح کشتار جمعی و عدم امکان رعایت قواعد ناظر بر حقوق مخاصمات مسلحانه را مطرح می‌کند، این موضوعات لزوم جرم‌انگاری، اتخاذ سیاست کیفری مؤثر و معاضدت بین‌المللی را طلب می‌کند. گذشته از اقدامات حقوقی، همکاری در حوزه بهداشت نیز در پاسخگویی مؤثر و موفقیت‌آمیز به یک حمله بیوتروریستی ضروری است.</div> <div style="text-align: justify;">Background and Aim: Biological terrorism is defined as the deliberate release of biological factors to cause disease or death in people, animals or the environment with the aim of creating terror and forcing the government or international organization to take action based on a political, national or religious attitude.The potential vulnerability to bioterrorism is very serious, in the United States in 2001, four mailings containing the anthrax bacteria resulted in the illness of 22 people, the death of 5 people and the cost of $23 million to clean up contaminated sites. Therefore, due to the deadly results of these attacks, all-round criminal fight against it should be considered in the domestic and international dimension. But there are serious challenges in knowing it as a crime against humanity. Methods: This article has been done in a descriptive-analytical way by collecting information in a library form and by referring to documents, books and articles. Ethical Considerations: In the present research, the ethical aspects of library study, including the authenticity of texts, honesty and trustworthiness, have been respected. Results: If biological attacks qualify as defined in Article 7 of the Statute of the International Criminal Court in the form of a "widespread" or "systematic" attack against a "civilian population" and with "knowledge of that attack", it can be committed. It is considered a crime against humanity and according to Security Council Resolution 1540 (2004), a framework is created for countries to prevent the development, acquisition, manufacture, or transfer of nuclear, chemical, or biological weapons by non-state actors as well, but the fight against biological terrorism requires a simultaneous national and international response from technical and specialized aspects. These attacks are increasingly favored by terrorist groups due to the large number of casualties, long-term complications, rapid spread and lack of efficient identification systems, the spread of the feeling of insecurity, the existence of a latent period, cheap costs and easy access. For this reason, the criminalization of these attacks is important both in domestic laws and in international obligations and a mere legal response is not enough in the fight, but the dimensions of international cooperation should also include technical, medical and security measures Conclusion: Bioterrorism is a serious threat from terrorist groups and the intersection of international law and human rights (the right to life, the right to health and the right to a healthy environment) in the field of threats to national and international security, human rights violations and it is considered peace. Therefore, in the criminal dimension, the issue of criminalization, the jurisdiction of the courts, international assistance and in the dimension of the law of armed conflict, severe civilian casualties, support for victims, the possibility of terrorist attacks reaching the threshold of an armed attack, acting as a weapon of mass destruction and the impossibility of observing the rules of supervision raises the issue of armed conflict rights, these issues require criminalization, the adoption of an effective criminal policy and international assistance.
