fa مسئولیت کیفری ناشی از نقض حق اختراعات دارویی توسط هوش مصنوعی Criminal Liability Arising from Infringement of Pharmaceutical Patents by Artificial Intelligence مقاله پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: هوش مصنوعی یکی از ابداعات بشری است که صرف ‌نظر از مزیت‌های فراوان، مشکلاتی را علی‌الخصوص در بعد کیفری ایجاد نموده است. هوش مصنوعی به ایده‌های نوین در حوزه اختراعات دارویی با گرد هم آوردن حجم گسترده‌ای از داده‌ها می‌تواند در کشف داروها، تحقیقات و عوارض آن یاری رساند. در واقع ویژگی خاص هوش مصنوعی که به عنوان ابراز کاربردی به وسیله ربات‌ها و برنامه‌نویسان صورت می‌گیرد، حقوقدانان را در خصوص مسئولیت کیفری ناشی از نقض برخی از حقوق نظیر حق اختراع و حقوق مالکیت فکری که نیازمند ویژگی‌هایی چون ثبت، اصالت، نوآوری و مالکیت را با چالش مواجه می‌سازد. خلأ قانونی موجود، بعضاً در باب انتساب مسئولیت کیفری به ربات‌ها، سازندگان (طراحان) و بهره‌برداران را علی‌الخصوص در حوزه سلامت که اهمیت فراوانی دارد، با ابهام مواجه ساخته و از سوی دیگر طبق اصل قانونی جرم و مجازات، هیچ جرمی نباید بدون مجازات و جبران خسارت باقی بماند. روش: در این نوشتار با رویکردی تحلیلی ـ توصیفی علیرغم کمبود منابع دسته اول حقوقی در این باب، به بررسی مسئولیت کیفری نقض حق اختراع توسط هوش مصنوعی پرداختیم. ملاحظات اخلاقی: در کلیه مراحل نگارش مقاله پیش روی، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های این نوشتار حاکی از آن است که علیرغم تأثیر گسترده هوش مصنوعی در حمایت از محصولات دارویی در قالب حق اختراع، در محدود مواردی موجب نقض اصول حق اختراع نظیر حق مالکیت و ثبت می‌شود، گرچه حق ابتکار و نوآوری را با بهره‌گیری از ربات‌ها در حوزه داده‌ها، یادگیری و عوارض پوشش می‌دهد. نتیجه‌گیری: چنین نتیجه گرفتیم که در انتساب مسئولیت کیفری به هوش مصنوعی در حق اختراعات دارویی به دلیل نبود اراده و اختیار برای ربات، وی را نه می‌توان در دسته اشخاص حقیقی و نه حقوقی قرارداد و ناچار باید به اراده و اختیار و البته قصد سازنده و استفاده‌کننده از رباب به عنوان مباشر و فاعل معنوی رجوع نمود.</div> <div style="text-align: justify;">Background and Aim: Artificial intelligence is one of the human inventions that, regardless of its many advantages, have created problems, especially in the criminal dimension. Artificial intelligence can help new ideas in the field of pharmaceutical inventions by gathering a large amount of data in the discovery of drugs, research and its side effects. In fact, the special feature of artificial intelligence is that it is applied as a practical expression by robots and programmers, challenges lawyers regarding the criminal liability resulting from the violation of some rights such as patent and intellectual property rights that require characteristics such as registration, originality, innovation and ownership. Robots, manufacturers (designers) and operators, especially in the field of health, which is very important, have faced ambiguity, and on the other hand, according to the legal principle of crime and punishment, no crime should remain without punishment and compensation. Methods: In this article, with a descriptive analytical approach, despite the lack of first-class legal sources in this regard, we investigated the criminal liability of patent infringement by artificial intelligence. Ethical Considerations: In all stages of writing the article, honesty and trustworthiness have been observed while respecting the originality of the texts. Results: The findings of this article indicate that despite the widespread impact of artificial intelligence in the protection of pharmaceutical products in the form of patents, in limited cases it causes the violation of the principles of patents such as the right of ownership and registration, although the right of innovation and innovation is used. Conclusion: We concluded that in assigning criminal liability to artificial intelligence in pharmaceutical patent rights, due to the lack of will and authority for the robot, he cannot be classified as a natural or legal person, and he must be bound by the will and authority and, of course, the intention.
